3 3 Goals and Objectives  Recognition of the problem;  Development of a comprehensive policy;  Educate Participants;  Promote the Employee Assistance Program, EAP;  Implement a fair and respectful drug testing program that conforms to Federal drug testing standards.

4 4 The Policy  Based on the IBEW Portland and Northwest Indiana’s drug-free workplace programs. Indiana’s program began around 1989 and includes the unions and construction companies in the business roundtable. The Portland program began ten years ago with 1,000 and has grown to include 7,000 in three states.

5 5 Policy Requirements and Prohibitions  The use of alcohol or drugs by employees during working hours on the job site or on company property (including company vehicles) is absolutely prohibited.  Participants are required to submit to drug and/or alcohol testing in accordance with this policy.

6 6 Policy Requirements and Prohibitions  No participant will be tested for alcohol unless a reasonable suspicion exists that the person is under the influence of alcohol, or they are involved in an OSHA recordable on the job accident.  Participants subject to this policy continue to have access to the usual protections provided as part of their union membership.

7 7 Policy Requirements and Prohibitions  All participants of the program shall be considered part of the testing pool and will be tested over a 2 year period.  Participants will be selected randomly from the 50% pool.  Participants who complete the testing process will not be returned to the 50% pool.  At the same time there will be an ongoing 10% pool.

8 8 Testing Procedures  Names picked from the random pool.  ScreenSafe refers to member database to learn where the participant is working.  Designated (Company or Union) Representative called and informed to expect a fax regarding participants being tested.

9 9 Notification Procedures  ScreenSafe makes calls to Designated Representative in the AM.  Forms sent to Designated Representative: Testing Procedures for the Drug Free Alliance Notification Form List of Collection Sites

10 10 Notification Procedures  Designated Representative notifies participant of testing. Designated Representative reminds participant to bring photo I.D. Gives the participant the list of testing sites Informs participant that the test must performed before the end of the next business day  Designated Representative faxes Notification form back to ScreenSafe.

11 11 Testing Procedures  A participant that is currently unemployed will receive $50.00 from the Alliance for the time they took to take the test.  If the participant is employed he/she will receive one (1) hour off with regular wages and fringe benefits. (this excludes accelerated testing).

12 12 Testing Procedures - Safeguards  Integrity of specimens insured by utilization of one collection procedure at all sites  All labs have NIDA Approved  All Testing Sites are DHHS approved  All positives confirmed by GC/MS  MRO reviews all drug test positives

13 13 Testing Procedures – Safeguards  Urine samples separated into two containers at time of collection  Other forms of testing for participants with confirmed medical conditions  Blind testing

14 14 Testing Procedures  If the test is negative, no further action is taken.  If the test is positive, the Medical Review Officer (MRO) calls participant to validate reason for positive.  If no valid reason found, participant is in violation of policy.

15 15 Testing Procedures  Testing will also be done when there is “reasonable suspicion”.  Accelerated testing (follow-up) takes place (based on EAP recommendation) once a participant tests positive and has returned to work.

16 16 Policy Violations  Policy Violations can include; Having a positive test result. Failing to take a test as scheduled Failing to keep a scheduled appointment with EAP Failing to participate in and/or complete the assigned treatment or education program

17 17 Policy Violations  Policy Violations can include (continued); Substituting another substance or specimen Providing a dilute specimen for a second time without a valid medical explanation Providing a urine specimen which shows the presence of an adulterant

18 18 Consequences  Upon a first positive test; Participant will be referred to the EAP for evaluation Participant must complete recommended treatment or education program Participant may be returned to work prior to program completion  The participant will be placed in a one year accelerated testing program.

19 19 Consequences  Upon a second positive test; Participant will be referred to the EAP for evaluation Participant must complete recommended treatment or education program Participant may be returned to work prior to program completion  The participant will be placed in a one year accelerated testing program.

20 20 Consequences  Upon a third positive test within a two-year period from the preceding (second); Participant will be referred to the EAP for evaluation Participant must complete recommended treatment or education program Participant may be returned to work prior to program completion  The participant will be placed in a one year accelerated testing program.  The participant will be required to sign a "Last Chance Agreement" between him/herself and the Program.

21 21 Non-compliance Procedures  ScreenSafe will let the Designated Representative know that the participant is unavailable.  ScreenSafe will inform the EAP of the participants non- compliance and the reason.  Participants will be asked to contact ScreenSafe.  Participants will receive written notices confirming their non-compliance and providing them with information to assist them in returning to compliance.  ScreenSafe will inform the Union that the member is unavailable.

22 22 Employment Verification Database  Through an internet based website the names of members who are in compliance with drug testing policy will be listed.  The only information that will be on the site is the members full name and Local Union Number and the last four digits of the social security number.  Participants will be found by matching the members last 4 digits of their social security number and first and last name

23 23 Employment Verification Database  Any further information the participant will need to contact ScreenSafe  Each contractors Designated Representatives will be assigned a user name and password.  The passwords will be changed every 30 days the same password can not be used.  If they are not in compliance with the Drug Policy they will show as “not found” if a member is compliant the participants name and Local number will show
