Security Awareness each hazmat employee must receive training that provides an awareness of security risks associated with hazardous materials transportation and methods designed to enhance transportation security. This training must also include a component covering how to recognize and respond to possible security threats. 6 General Awareness The employee must be familiar with the requirements of CFR-49 sub chapter C (hazmat related) and be able to recognize and identify hazardous materials consistent with the hazard communication standards of CFR-49. e.g. hazardous labels, placards shipping papers.

7 Function Specific Function-specific training.
Each hazmat employee must be provided function-specific training concerning requirements of this subchapter, or exemptions or special permits issued under subchapter A of this chapter, that are specifically applicable to the functions the employee performs. As an alternative to function-specific training on the requirements of this subchapter, training relating to the requirements of the ICAO Technical Instructions and the IMDG Code may be provided to the extent such training addresses functions authorized by subpart C of part 171 of CFR49

8 Safety Safety training.
Each hazmat employee shall receive safety training concerning– (i) Emergency response information required by subpart G of part 172; (ii) Measures to protect the employee from the hazards associated with hazardous materials to which they may be exposed in the work place, including specific measures the hazmat employer has implemented to protect employees from exposure; and (iii) Methods and procedures for avoiding accidents, such as the proper procedures for handling packages containing hazardous materials. OSHA, EPA and other training may be used if it relates to the training requirements of § (a)

9 Security Security Awareness
Each hazmat employee must receive training that provides an awareness of security risks associated with hazardous materials transportation and methods designed to enhance transportation security. This training must also include a component covering how to recognize and respond to possible security threats. New hazmat employees must receive the security awareness training required by this paragraph within 90 days after employment. 17 UN Lithium Battery Testing Requirements

They may be transported under these entries if they meet the following provisions: each cell or battery is of the type proved to meet the requirements of each test of the UN Manual of Tests and Criteria, Part III, subsection However, batteries and cells manufactured before 1 January 2014 conforming to a design type tested according to the requirements of the 5th revised edition of the UN Manual of Tests and Criteria, Part III, subsection may continue to be transported; Note: Batteries must be of a design type proved to meet the testing requirements of the Manual of Tests and Criteria, Part III, subsection 38.3, irrespective of the whether the cells of which they are composed are of a tested design type. each cell and battery incorporates a safety venting device or is designed to preclude a violent rupture under conditions normally incident to transport; each cell and battery is equipped with an effective means of preventing external short circuits; each battery containing cells or series of cells connected in parallel is equipped with effective means as necessary to prevent dangerous reverse current flow (e.g., diodes, fuses, etc.); (e) cells and batteries must be manufactured under a quality management program….

20 DOT Special Provisions 188 &189
188 Exceptions for Small Quantities Li-ion cells -1.5g ELC (approx. equivalent ~ 20 Wh) ELC (Equivalent lithium content ) means, for a lithium-ion cell, the product of the rated capacity, in ampere-hours, of a lithium-ion cell times 0.3, with the result expressed in grams. The equivalent lithium content of a battery equals the sum of the grams of equivalent lithium content contained in the component cells of the battery. The calculation used to determine lithium content is: Ah per cell x 0.3 gm x number of cells • It requires about 0.3 grams of lithium metal to produce 1 ampere hour of power. Example, if the battery you wish to ship is rated at 5,300 mAh per cell and contains 8 cells: • Divide 5,300 mAh by 1,000 to get the rating in ampere hours: 5,300 mAh ÷ 1,000 = 5.3 Ah • Multiply the Ah by 0.3 gm to determine the amount of lithium in each cell: 5.3 x 0.3 gm = 1.59 grams of lithium in each cell Multiply the amount of lithium in each cell by the number of cells in each battery: 1.59 grams/cell x 8 = grams of lithium in the battery 189 Exceptions to Medium Lithium Cells & Batteries

21 DOT Special Provisions for Air A54 & A55
A54 Lithium batteries or lithium batteries contained or packed with equipment that exceed the maximum gross weight allowed by Column (9B) of the §  Table may only be transported on cargo aircraft if approved by the Associate Administrator. A55 Prototype lithium batteries and cells that are packed with not more than 24 cells or 12 batteries per packaging that have not completed the test requirements in Sub-section 38.3 of the UN Manual of Tests and Criteria (incorporated by reference; see § 171.7 of this subchapter) may be transported by cargo aircraft if approved by the Associate Administrator A55 Prototype Specifics The following requirements must be met: a. The cells and batteries must be transported in rigid outer packagings that conform to the requirements of Part 178 of this subchapter at the Packing Group I performance level; and b. Each cell and battery must be protected against short circuiting, must be surrounded by cushioning material that is non-combustible and non-conductive, and must be individually packed in an inner packaging that is placed inside an outer specification packaging

22 Other DOT Special Provisions for Air
Primary (non-rechargeable) lithium batteries and cells are forbidden for transport aboard passenger carrying aircraft. Secondary (rechargeable) lithium batteries and cells are authorized aboard passenger carrying aircraft in packages that do not exceed a gross weight of 5 kg. A101 A primary lithium battery or cell packed with or contained in equipment is forbidden for transport aboard a passenger carrying aircraft unless the equipment and the battery conform to the following provisions and the package contains no more than the number of lithium batteries or cells necessary to power the intended piece of equipment: (1) The lithium content of each cell, when fully charged, is not more than 5 grams. (2) The aggregate lithium content of the anode of each battery, when fully charged, is not more than 25 grams. (3) The net weight of lithium batteries does not exceed 5 kg (11 pounds). A103 Equipment is authorized aboard passenger carrying aircraft if the gross weight of the inner package of secondary lithium batteries or cells packed with the equipment does not exceed 5 kg (11 pounds). A104 The net weight of secondary lithium batteries or cells contained in equipment may not exceed 5 kg (11 pounds) in packages that are authorized aboard passenger carrying aircraft.

25 Why do DG’s need regulated packaging standards?

26 A Special Permit A Special Permit (formerly called an exemption) means a document issued by the Associate Administrator under the authority of 49 U.S.C The document permits a person to perform a function that is not otherwise permitted under Subchapter A or C of this chapter, or other regulations issued under 49 U.S.C through 5127 (e.g., Federal Motor Carrier Safety routing).

27 Definitions Packing group means a grouping according to the degree of danger presented by hazardous materials. Packing Group I indicates great danger; Packing Group II, medium danger; Packing Group III, minor danger.

28 Specification Packaging
A manufacturer must mark every packaging that is represented as manufactured to the UN standard with the appropriate marks. They must be readily durable, legible and visible Notification. The manufacturer or other person certifying compliance with the requirements of this part, and each subsequent distributor of that packaging must: (i) Notify each person to whom that packaging is transferred— (A) Of all requirements in this part not met at the time of transfer, and (B) With information specifying the type(s) and dimensions of the closures, including gaskets and any other components needed to ensure that the packaging is capable of successfully passing the applicable performance tests. This information must include any procedures to be followed, including closure instructions for inner packagings and receptacles, to effectively assemble and close the packaging for the purpose of preventing leakage in transportation. Closure instructions must provide for a consistent and repeatable means of closure that is sufficient to ensure the packaging is closed in the same manner as it was tested. For packagings sold or represented as being in conformance with the requirements of this subchapter applicable to transportation by aircraft, this information must include relevant guidance to ensure that the packaging, as prepared for transportation, will withstand the pressure differential requirements in § of this subchapter. 29 Combination Packaging
Means a combination of packaging, for transport purposes, consisting of one or more inner packagings secured in a non-bulk outer packaging. It does not include a composite packaging.

30 Single Packaging Single packaging means a non-bulk packaging other than a combination packaging

32 Overpacks An Overpack does not include a transport vehicle, freight container, or aircraft unit load device. Examples of an overpack is one or more packages: (1) Placed or stacked onto a load board such as a pallet and secured by strapping, shrink wrapping, stretch wrapping, or other suitable means; or (2) Placed in a protective outer packaging such as a box or crate.

40 Variation Packaging Selective testing of combination packagings. Variation 2. Articles or inner packagings of any type, for solids or liquids, may be assembled and transported without testing in an outer packaging under the following conditions: (i) The outer packaging must have been successfully tested in accordance with §  with fragile (e.g. glass) inner packagings containing liquids at the Packing Group I drop height; (ii) The total combined gross mass of inner packagings may not exceed one-half the gross mass of inner packagings used for the drop test; (iii) The thickness of cushioning material between inner packagings and between inner packagings and the outside of the packaging may not be reduced below the corresponding thickness in the originally tested packaging; and when a single inner packaging was used in the original test, the thickness of cushioning between inner packagings may not be less than the thickness of cushioning between the outside of the packaging and the inner packaging in the original test. When either fewer or smaller inner packagings are used (as compared to the inner packagings used in the drop test), sufficient additional cushioning material must be used to take up void spaces. (iv) The outer packaging must have successfully passed the stacking test set forth in §  of this subpart when empty, i.e., without either inner packagings or cushioning materials. The total mass of identical packages must be based on the combined mass of inner packagings used for the drop test; (v) Inner packagings containing liquids must be completely surrounded with a sufficient quantity of absorbent material to absorb the entire liquid contents of the inner packagings; (vi) When the outer packaging is intended to contain inner packagings for liquids and is not leakproof, or is intended to contain inner packagings for solids and is not siftproof, a means of containing any liquid or solid contents in the event of leakage must be provided in the form of a leakproof liner, plastic bag, or other equally efficient means of containment. For packagings containing liquids, the absorbent material required in paragraph (g)(2)(v) of this section must be placed inside the means of containing liquid contents; and (vii) Packagings must be marked in accordance with §  of this part as having been tested to Packing Group I performance for combination packagings. The marked maximum gross mass may not exceed the sum of the mass of the outer packaging plus one half the mass of the filled inner packagings of the tested combination packaging. In addition, the marking required by §  (a)(2) of this part must include the letter “V”.

51 OVERPACK. An enclosure used by a single shipper to contain one or more packages and to form one handling unit for convenience of handling and stowage. Dangerous goods packages contained in the overpack must be properly packed, marked, labelled and in proper condition as required by these Regulations. A Unit Load Device is not included in this definition. Shrink-wrap or banding may be considered an overpack.

52 OVERPACKS The shipper must ensure that where an overpack is used to enclose packages of dangerous goods, the following requirements must be met: The overpack must not contain packages enclosing different substances which might react dangerously with each other or packages of dangerous goods which require segregation according to Table 9.3.A. Each package contained within an overpack must be properly packed, marked, labelled and be free of any indication of damage or leakage and in all respects be properly prepared as required in these Regulations. Packages must be secured within the overpack. The overpack must not contain packages bearing the Cargo Aircraft Only label except where: only one package is contained in the overpack; or two or more packages are contained in the overpack and the packages are assembled in such a way that clear visibility and easy access to them is possible; or the packages contain substances of:  flammable liquids (Class 3), Packing Group III, other than those with a subsidiary risk of Class 8;  toxic substances (Division 6.1) with no subsidiary risk other than Class 3; infectious substances (Division 6.2);  radioactive materials (Class 7); miscellaneous dangerous goods (Class 9). The intended function of each package must not be impaired by the overpack

Prototype lithium batteries and cells to be tested that are packed with not more than 24 cells or 12 batteries per packaging that have not been tested to the requirements in subsection 38.3 of the UN Manual of Tests and Criteria may be transported on cargo aircraft if approved by the appropriate authority of the State of Origin and the following requirements are met: a) The cells and batteries must be transported in an outer packaging that is a metal, plastic or plywood drum or a metal, plastic or wooden box and that meets the criteria for packing group I packagings; and, b) Each cell and battery must be individually packed in an inner packaging inside an outer packaging and surrounded by cushioning material that is non-combustible, and non-conductive. Cells and batteries must be protected against short circuiting.

56 IATA Special Provision A99
Irrespective of the limit specified in column 9 of the DG List Section 4.2, a lithium battery or battery assembly that has successfully passed the tests specified in the and meets the requirements of packing instruction 965 (lithium-ion battery)or 968 (Lithium metal batteries)as prepared for transport, may have a gross mass exceeding 35 kg, if approved by the appropriate authority of the State of Origin. A copy of the document of approval must accompany the consignment.

Lithium batteries which the manufacturer has identified as being defective for safety reasons or have been damaged and have the potential to produce a dangerous evolution of heat, fire or short-circuit, are forbidden from air transport,

58 IATA Special Provision A164
Any electrical battery or battery powered device, equipment or vehicle having the potential of a dangerous evolution of heat must be prepared for transport so as to prevent: a) a short circuit (e.g. in the case of batteries, by effective insulation of exposed terminals; or in the case of equipment, by disconnection of the battery and protection of exposed terminals); and, b) unintentional activation.

59 IATA Special Provision A181
When a package contains a combination of lithium batteries contained in equipment and lithium batteries packed with equipment, the package must be marked UN 3091 Lithium metal batteries packed with equipment, or UN 3481, Lithium ion batteries packed with equipment as appropriate. If a package contains both lithium ion batteries and lithium metal batteries, the package must be marked as required for both battery types. However, button cell batteries installed in equipment (including circuit boards) need not be considered.

Packaging Requirements: Cells and batteries must be placed in inner packagings that completely enclose the cell or battery then placed in an outer packaging. Packagings must meet Packing Group II performance requirements. Lithium batteries with a mass of 12 kg or greater and having a strong, impact-resistant outer casing, or assemblies of such batteries, may be transported when packed in strong outer packagings and protective enclosures not subject to the requirements of Chapter 6, if approved by the appropriate authority of the State of origin. A copy of the document of approval must accompany the consignment.

Each person who provides a shipping paper must retain a copy of the shipping paper required by § (a), or an electronic image thereof, that is accessible at or through its principal place of business and must make the shipping paper available, upon request, to an authorized official of a Federal, State, or local government agency at reasonable times and locations.
