1 Preparation for test Chapter Two
60 mark exam chosen from the following questions: 1. Evaluate the role and the functions of the NCA in protecting consumers (20 marks). 2. Discuss the main provisions of the CPA Act which help protect consumer rights (10 marks). 3. Discuss the five main provisions of the Sale of Goods and Supply of Services Act 1980 (25 marks). (ii) Evaluate the effectiveness of this Act. (10 marks). 4. Evaluate the role of each of the following in protecting consumers: (i) The Small Claims Court (ii) The Office of the Ombudsman for Public Services (20 marks)

2 Important Hints Roughly speaking 5 marks = one paragraph where a point is stated, explained and then backed up with an example or further expansion. When you see the word “Evaluate” the marking scheme is less predictable. Make sure to add in the line “I think this is good because…” or “this is effective because…” you will not get full marks without this.

3 Planning your answers Q1. Evaluate the role and the functions of the NCA in protecting consumers (20 marks). Marking scheme 6 (3+3) +2 Therefore, I am looking for three fully developed points (State, Explain, Expand/Example). Choose functions you can write a good bit on! The final 2 marks are for your evaluation…”I think the NCA is effective in protecting consumers because it is a statutory body, an advocate for consumer rights and has real enforcement powers, e.g. the publication of the Consumer Protection List.”

4 Planning your answers 2. Discuss the main provisions of the CPA Act which help protect consumer rights (10 marks). (2+2+1) Discuss 2 provisions e.g. false pricing, aggressive practices, false description and fully explain and give an example. 3. Discuss the five main provisions of the Sale of Goods and Supply of Services Act 1980 (25 marks). (2+3) Goods, Services, Contract, Signs, Guarantees. Within “Goods” outline the five points briefly.

5 Planning your answers 3(ii) Evaluate the effectiveness of this Act. (10 marks). (2+3 State +explain) I think this Act is good because…2 reasons… 4. Evaluate the role of each of the following in protecting consumers: (i) The Small Claims Court (ii) The Office of the Ombudsman for Public Services (20 marks) (4+4+2) SCC: 2 paragraphs discussing it + sentence on why it is effective. Ombudsman: 2 paragraphs discussing it + sentence on why it is effective.
