IMPACT ICOTS: None Rule/Opinion: None Compact Office: Your state’s document retention policies determine whether amendment is applicable to outgoing cases Field Users: As directed by Compact Office Provides an OPTION for a sending state to retain electronic copies removing the requirement to retain original signed forms Amendment to Rule & 3.107

IMPACT ICOTS: None-Victim comment does not delay time frames for responding to transfer requests Rule/Opinion: None Compact Office: Ensure your state’s policies comply Field Users: None Expands the time frame a victim can provide comment regarding an interstate transfer request to 15 business days Amendment to Rule

6 New documentation Requirements for Military & Employment Transfer Reasons
IMPACT ICOTS: Documentation may be provided within the ‘conditions’ section OR use NEW ‘Reason’ attachment in RFRI Rule/Opinion: None Compact Office: Ensure documentation supports reason for transfer Field Users: Require offender to provide documentation when requesting transfer Note, these are all infrequent reasons for transfer; this type of documentation should have already been obtained previously for the sending state to know the offender meets the qualifying reason for transfer. Now documentation has to be provided to RS. A high percentage of these requests are found to not meet the requirements of these rules once documentation is received. It is incumbent upon the sending state to provide documentation as part of the request. Amendment to Rule

7 Returning Offenders Provide ‘Reason’ for Return
8/27/2018 Returning Offenders Receiving States Sending States Provide ‘Reason’ for Return Supervise until Departure! Offender absent from approved residence and employment? Follow absconder rule! Return Date Clarification- 15 biz days after request received Confirm Arrival (or failure to arrive) PRIOR to validating closure SS must provide a date to return within 15 days of receiving the RI request (example: received on Tue (Aug 2nd), must reply by Thurs (Aug 4th), date to return must be no later than Tue (Aug 23rd) RS is responsible until CONFIRMATION the offender departed back to SS. Anytime RS is unable to locate offender pending return, absconder requirements to attempt to locate must be conducted. COMPACT OFFICES must confirm NOA is sent prior to transmitting the CCN reply-Check offender profile. It’s up to your office to ensure compliance and the offender’s return is documented! Amendments to Rule 4.111

Sending State Return date must by within 15 biz days Ensure NOA has been sent prior to validating closure- Review profile! Field Users (RS): Provide reason for return. Remember supervision does NOT stop at rejection! Amendments to Rule 4.111

8/27/2018 Rejection of Transfer-Offender in Receiving State w/RI’s Receiving States Sending States Clear, concise rejections! (Return to SS vs Remain pending new TREQ) Compact office reviews rejections and determines when this rule is applied or when return RI’s are needed The receiving state’s rejection initiates this process informing the sending state of an alternate plan to be submitted within 15 business days Rejection indicates alternate plan exists in RS Submit new TREQ within 15 biz days SS must provide a date to return within 15 days of receiving the RI request (example: received on Tue (Aug 2nd), must reply by Thurs (Aug 4th), date to return must be no later than Tue (Aug 23rd) RS is responsible until CONFIRMATION the offender departed back to SS. Sending State When rule is applied by RS, ensure subsequent TREQ is submitted within 15 biz days Field Users: RS-Ensure rejection is clear whether offender is allowed to remain or if return RIs will be submitted Amendment to Rules & 4.111

19 Recommendations for DCA Region Meetings
Identify Best Practices for Violation & PC Documentation Encourage collective solutions for training issues Promote effective communication Share ideas! Lots of requests for what good violation reports or good hearing waivers or reports, states should be sharing If issues affect multiple states (subpoenas, Indian reservations, supervision practices, etc.) share how your state deals with that situation Effective communication—most instances where states don’t agree in a situation are simply looking at the rules in a different way based on their take. If it hasn’t gotten to the point where your commissioner is requesting an opinion from our office or reporting an incident of a rule violation, it’s a communication issue between the two states.

Assist with tools/resources Consult or serve in DCA mentoring program ICOTS Reports, UAT & Enhancement Training Including IVINS (ICOTS VINEWatch) administration Public Relations Website content review Communications feedback In addition to trainers role as presenters or assistants during training, the national office with ever growing resources and growing training needs with ICOTS and IVINS, may call on volunteers to review documents or tools to ensure they are up-to-date, consult in DCA mentoring program, ICOTS and IVINS training as well as assist in the national office’s public relations efforts in occasional review of website content and providing feedback for communications (e.g. weekly, emergency notifications, ABM registration or web page feedback)
