Freedom of Assembly Freedom of Petition Freedom of Press Freedom of Speech

2 Civil Liberties Unit Freedom of Speech- pure speech and symbolic speech or (expressive conduct) Cannot say Seditious Speech…or anything urging resistance to lawful authority or to overthrow the government. Clear and Present Danger: cannot yell fire in a crowded theater b/c people will be hurt.

3 Civil Liberties Unit Freedom of the Press:
No prior restraint- stopped before publication Can’t just print anything, especially if it is a lie! Ex: Libel or Slander/ written and spoken Obscenity- Miller v. California…what may be obscene in Maine, may be tolerable conduct in Las Vegas or New York.

4 Civil Liberties Unit Freedom of Religion
Establishment Clause- Congress shall make no law respecting an establishment of religion Free Exercise Clause- prohibits gov from unduly interfering with the free exercise of religion Affected schools the most part.

5 Civil Liberties Unit Freedom to Assemble
Means you can assemble in public places, as long as you are not creating a disturbance or endangering other citizens. Teenagers cannot stand around in the mall, not doing anything, creating a scene. This would be classified as disturbing the peace and officials would ask them to disperse for their own safety, and for order in the mall.

6 Petition Right to ask the government to make changes, and have the force of numbers, or citizens requesting that change.

7 14th Amendment Grants citizenship to all persons born in the United States. Guaranteed due process of the law from all state governments. Guaranteed equal protection of the laws from all state governments.

8 2nd Amendment Right to bear arms.
You can have a weapon to protect yourself. The government can regulate that weapon and how you obtain and keep it.
