4 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union INSTITUTIONAL FRAMEWORK Chapter 27: Environment Chapter 27: ENVIRONMENT Supervision of implementation of the law is done by the Ministry of Sustainable Development and Tourism (4 employees), and inspection supervision is conducted by environmental inspectors (7 employees). Inspection supervision of the existence of tags with the inscription manufacturers market perform inspections. (no employees) Inspection supervision of the existence of labels indicating the producer and labels on mandatory separate collection of waste generated from products for which the extended producer responsibility is prescribed shall be performed by market inspectors. (no employees) The Environmental Protection Agency shall be responsible for keeping records on waste, keeping a register of collectors, dealers and intermediaries, issuing permits for the treatment and/or disposal of waste In addition, the Environmental Protection Agency shall keep a register of data on waste generation and management on the basis of data from the annual reports on waste and issued permits, and keeping records on the manufacturers and importers of products resulting in special types of waste (3 employees). 5 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union TRANSPOSITION OF THE DIRECTIVE The provisions of this Directive were transposed to the following regulations in Montenegro: The Waste Management Law ("Official Gazette of Montenegro", 64/11) Decree on the method and procedure for establishing the system for acceptance, collection and treatment of waste batteries and accumulators and operation of the system ("Official Gazette of Montenegro", 39/12). Approximately 65% of Directive 2006/66/EC was transposed to the applicable regulations. 6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union CURRENT AND PLANNED SITUATION – OBJECTIVES In accordance with the projection, which was done on the basis of both our and the experiences of the European Union, the estimated amount of waste batteries and accumulators that is produced annually by households and similarly by corporate entities varies from 0.05 to 0.1 kg /capita or at least 30 tones per year for the whole area Montenegro. Economic operators of industrial and automotive batteries and accumulators shall ensure as of 1 January 2014 the following: The level of collection and storage of batteries of 25%; The level of recycling of 65% of the average weight of lead-acid batteries and accumulators with acid, including the recycling of lead batteries and accumulators; The level of recycling of 75% of the average weight of nickel-cadmium batteries and accumulators; The level of recycling of 50% of the average weight of other waste batteries and accumulators. 7 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union LEGAL FRAMEWORK Waste batteries and accumulators shall be collected separately from other wastes. Dumping and incineration of waste industrial and automotive batteries and accumulators shall be prohibited. Producers and importers of batteries and accumulators shall join an organized system of acquisition, collection and treatment of waste batteries and accumulators. Producers and importers of batteries and accumulators shall bear the costs of an organized system of acquisition, collection and treatment of waste batteries and accumulators. 8 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union EXTENDED PRODUCER RESPONSIBILITY Extended responsibility of producers of batteries and accumulators is described in detail by the Decree on detailed criteria, amount and manner of payment of special waste management fees Under this Decree, any manufacturer and importer of batteries and accumulators shall report the activity to the Environmental Protection Agency, and the Agency shall submit the registration of activity to the Tax Administration within three days of filing this application Chapter 27: Environment Chapter 27: ENVIRONMENT Chapter 27: Environment and Climate Change Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

9 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union CONCESSION ACT AND TENDER DOCUMENTS In accordance with the Law on Concessions ("Official Gazette of Montenegro", 08/09) and the Law on Waste Management ("Official Gazette of Montenegro", 73/08) the Concessionary Act was adopted by the Government of Montenegro for performing the activities of acceptance, collection and treatment of special wastes. The preparation of tender documents is in progress for the selection of processors of waste batteries and accumulators, waste tires, waste vehicles, waste from electronic and electrical products and waste packaging. The concession will be given to carry out the tasks of acquisitions, collection and processing of special wastes throughout Montenegro. 10 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union SUBJECT OF CONCESSION Planned annual amounts of waste batteries and accumulators to be taken by distributors and municipal enterprises are, in certain areas inter-municipal networks of regional landfills, listed in the table. Storage location for temporary storage of waste batteries and accumulators is not determined in advance, and should have good road connections. 12 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union PENAL PROVISIONS Establishing penalties is governed by the Law on Waste Management, that is a fine of 500 up to 20 000 Euros shall be imposed on a legal person, if: – failing to deliver waste batteries and accumulators which, in accordance with the waste catalog, are not municipal waste to the company or entrepreneur dealing with the activities of collecting, processing or removal of specific types of waste; – failing to deliver waste batteries and accumulators which are municipal waste in accordance with the Waste Catalogue to places that are designed for this type of waste as part of the separate collection of municipal waste or to the distributor’s locations designated for the collection of these types of waste; – disposing of or incinerating waste automotive and industrial batteries and accumulators; – a producer or importer of batteries and accumulators fails to join an organized system for the acquisition, collection and treatment of waste batteries and accumulators.
