3 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE TRANSPOSITION Main instruments for transposition :  Waste Management Law (Official Gazette of Montenegro 64/11) and  Rulebook on the Procedure for Processing Equipment and Waste Containing PCB (OG MNE No. 48/12 of 14th September 2012). Total transposition score of the PCB/PCT Directive is 94,6%.

4 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Competent authorities Environmental Protection Agency is in charge to compile reports delivered by holders of PCB waste/equipment. Ecological inspection shall monitor disposal, decontamination and storage facilities.

6 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE IMPLEMENTATION The main problem for implementation are: lack of inventories of the existent PCB equipment; unavailability of data on storage and removal of obsolete equipment and waste oils containing PCB; lack of uniform instructions for identification, decontamination, use, transport, storage and disposal of PCB equipment or products. The Ministry of Sustainable Development and Tourism shall develop a National Action Plan for implementation of the Stockholm Convention in 2013.

7 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE IMPLEMENTATION Main requirements: The holder of equipment and waste containing PCBs is required to prepare a management plan for equipment and waste containing PCBs. The management plan for equipment and waste containing PCBs containing the measures planned for removal or decontamination, including replacement of fluids in accordance with Annex I Rulebook on the Procedure for Processing Equipment and Waste Containing PCB. The holder of equipment and waste containing PCBs shall keep records of equipment and PCB waste and PCB quantities of records and data submitted to the Agency by 31 March of the current for the previous year.

8 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Next steps Clean-up old stockpiles and equipment containing PCB/PCT Promote activities for elimination PCB and support industry to phase out “in-place equipment” such as electrical transformers and capacitates containing PCBs, as long as the equipment is maintained in a way that prevents leaks. This will require additional money and know-how. A problem in drawing up inventories for the identification of PCB transformers is that large numbers of different types of transformers have been designed and sold, and are now used across the world.
