3 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE TRANSPOSITION Directive 2009/30/EC is partially transposed into national legislation by Regulation on content of pollutants in liquid fossil fuels Regulation on content of pollutants in liquid fossil fuels transposes the parts of the Directive that originally belong to the Directive 98/70/EC which is fully transposed into Montenegrin legislation The remaining provisions shall be transposed through legislation on biofuels and amendments to the Regulation on content of pollutants in liquid fossil fuels Legal framework defined by the end of 2014

4 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation Since 1st January 2011 benzine with lead content greater than 0,005 g/l is prohibited at Montenegrin market So far the fuel quality regarding the content of the lead in fuel is regularly monitored through annual monitoring Programme for automotive fuels Authorized Accredited laboratories are engaged by suppliers (Polluter pays principle)

5 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation Program for monitoring of automotive fuels Methodology for the development program was established in the standards of EN 14274 - Annex D The total number of samples was determined on the basis of choice of statistical model C within the standards of EN 14274 and the variability factor of fuel quality in the Montenegrin market. Sampling location is determined by a statistical method from the register of gas stations and warehouses in Montenegro and assigns it a unique identification mark

8 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE AQ State Network Implementation Air Quality Monitoring South Critical Zone Urban Traffic station (UT) – Podgorica Parameters NO2, PM10, CO, benzene, benzo(a)pirene and lead Leaded benzine is prohibited at the market since 1st January 2011 Air quality analysis indicates that the concentration of lead has a downward trend and is below the prescribed limit

9 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation Currently, only the system for control of the fuel quality from the environmental point of view is in place /Ministry/EPA/Distributers/Accredited labs/ The establishment of biofuels market, system for GHG emission reductions from transport, system to verify sustainability of biofuels and calculate the life cycle of GHG emissions from biofuels is yet to be established

10 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Implementation plans Consumption of oil products by 2030 – Reference scenario (PJ, 1000 t) According to the orientation of EU energy policy, Montenegro will fulfil the requirement of 10% share of renewable energy in fuel consumption in the sector of transport according to the methodology of Directive 2009/28/EC by 2020 In addition to the use of electricity from RES this would require also introduction of biofuels according to the schedule shown in the Table ENERGY DEVELOPMENT STRATEGY OF MONTENEGRO BY 2030” (Green Book)

11 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Stepwise introduction of biofuels (biodiesel and biogasoline) in road transport shall start by 2015. The initial penetration would be 3%, with an annual increase of 1% which would result in 10% in 2020. Based on the forecast of final consumption of fuels in transport in the Reference scenario (Energy strategy, green book), this would result in a need of 285 GWh of biofuels (in case of biodiesel this would be 24 thousand tonnes) in 2020 and 252 GWh (21.3 thousand tonnes) in 2030. 12 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE In the scope of IPA 2010 Montenegro applied for funds (which are approved) for the project on sustainable energy use in transport sector whose significant part is related to: Study on biofuels potential and secondary biofuels production potential in Montenegro Action plan for introduction of renewable energy sources in transport sector Finalization of legislative framework on sustainable energy use in transport sector System for monitoring quality of produced and used biofuels The project duration is two years starting from the second half of 2013 Implementation plans

13 Chapter 27: Environment and Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT Providing pro-active involvement of numerous stakeholders at the state and local level Inclusion of new provisions on new measures of sustainable energy use into existing legal system Data inaccessibility and discordance Scrutinizing records from current data-collection systems and fitting them into one comprehensive monitoring system on bio fuel consumption Implementation challenges Chapter 27: ENVIRONMENT AND CLIMATE CHANGE
