2 In accordance with the 24 September 2007 Regulations for organisation and operation of the Chamber of Fiscal Consultants, the Directorate for National and International Relations has the main responsibilities below: a)conduct research on tax consulting and on professional organisations from other states and briefing the Superior Council and the Standing Bureau; b)ensure the performance of the actions required for the Chamber to affiliate to the specialist international professional bodies, initiate and enter into accords/arrangements with similar organisations from other states concerning the practice of the tax adviser profession domestically and abroad; c)ensure collaboration and co-operation with institutions from other states that are active in the tax consulting industry; d)ensure that the Chamber members participate in various national and international professional events; e)develop proposals for updating the applicable legislation and the tax consulting methodology; f)ensure collaboration and co-operation with other professional organisations in Romania; g)fulfil any other responsibilities established by the Higher Council and by the Standing Bureau. 3 Activities undertaken starting with 2008 by the National and International Relations Department of the Romanian Chamber of Fiscal Consultants (CCFR) The participation at the 17 January 2008 meeting of the Superior Council of the Confederation Fiscale Europeenne (CFE) in Brussels to present and support the Romanian Chamber of Fiscal Consultants (CCFR) and to submit the candidacy of the CCFR for membership of the European Fiscal Confederation (CONFÉDÉRATION FISCALE EUROPÉENNE); 1)The participation at the 17 January 2008 meeting of the Superior Council of the Confederation Fiscale Europeenne (CFE) in Brussels to present and support the Romanian Chamber of Fiscal Consultants (CCFR) and to submit the candidacy of the CCFR for membership of the European Fiscal Confederation (CONFÉDÉRATION FISCALE EUROPÉENNE); The participation between 26 to 27 September 2008 in Madrid at the proceedings of the General Assembly of the Confederation Fiscale Europeenne and presenting the Romanian Chamber of Fiscal Consultants to the members of the General Assembly of the Confédération Fiscale Européenne to support the Romanian Chamber of Fiscal Consultants’ joining the Confederation Fiscale Europeenne. 2) The participation between 26 to 27 September 2008 in Madrid at the proceedings of the General Assembly of the Confederation Fiscale Europeenne and presenting the Romanian Chamber of Fiscal Consultants to the members of the General Assembly of the Confédération Fiscale Européenne to support the Romanian Chamber of Fiscal Consultants’ joining the Confederation Fiscale Europeenne. During this meeting the approval by unanimous consent was granted on the adhering by the Romanian Chamber of Fiscal Consultants to the Confédération Fiscale Européenneas an observer member alongside Russia (approved during the same meeting) and by Bulgaria and Croatia (adhesion previously approved by the CFE). 4 3) Organising on 4 November 2008 in Bucharest of the International Seminar named “The tax adviser profession in a European context”, having as guests the following CFE members: Stephen Coleclough – CFE President – presentation on the “Confédération Fiscale Européenne and its role in organising the tax advisory practice in Europe”; Kaloyan Stoyanov – president of ASEFID (Swiss Association of Certified Tax Experts) – presentation on the ”Development of the tax adviser profession – the Swiss experience”; Theodore Vassilopoulos – P.O.F.E.E. – International Relations Panhellenic Federation of Freelance Tax Advisers and Experts – presentation on “Tax Consulting and Accounting – the Greek experience”; Dr. Janusz Fiszer – President of the International Relations Board of the Polish National Council of Tax Advisers – presentation on “the tax adviser profession as organised in Poland”; Knut Henze - Steuerberaterkammer Schleswig-Holstein – General Director – presentation on the “Tax adviser profession as organised in Germany – reference model for Romania”. 4) 4) Organising together with the Accounting and Management Information Systems Faculty within the Academy of Economic Studies (ASE) – Bucharest, between 13 and 15 November 2008 – of the “NATIONAL OLYMPICS OF THE ECONOMICS UNDERGRADUATES –ACCOUNTING and MANAGEMENT INFORMATION SYSTEMS”. The aim of this partnership was to encourage top performance in professionally and scientifically training undergraduates, aiming to develop the scientific research competences in the field of economics, alongside with working abilities, team spirit, good judgment and competition. The Romanian Chamber of Fiscal Consultants awarded prizes to the first-place winners in all the three sections of the Olympics: Accounting (graduation paper), Financial Information and Management Information Systems (graduation paper) and Accounting and Management Information Systems (master’s degree paper). 5 5) Organising on 20 November 2008, in Bucharest, together with the company OXFORD TAX SOLUTIONS, of the International Tax Conference named “International Tax Planning – a theoretical and practical approach”, having as guests the following foreign speakers : Ewout Langemeijer – advisor on International tax matters, the Netherlands; Athos Fouttis – General Manager of OXFORD MANAGEMENT LTD, Cyprus; Andrew Greenfield – partner at Dawsons LLP law firm, UK. 6) The participation of the members nominated by the Superior Council of the Chamber of Fiscal Consultants, Mr. Ionuţ Ştefan and Mr. Călin Obadă, in the professional affairs conferences and forums held by the Confédération Fiscale Européenne, namely: ““ a) CFE Brussels forum of 3 April 2008, having as topics “The Taxpayer‘s Charter – a Model for Europe” and “VAT formalities for electronic invoicing - a challenge for Europe‘s businesses”; b) CFE Global Conference on Professional Affairs held in Brussels on 26 November 2008, having as topic “The Tax Adviser profession: ownership and cooperation - How much regulation is needed?”, comprising two sections: “Risks of external ownership and regulatory responses; multidisciplinary activities under the EU Directive on Services” and “The pervasiveness of European Community Law”. The first international tax seminar was organised between 28 and 29 March 2009 together with the Spanish tax administration and CCF counterparts from Spain, with the debates focusing on direct and indirect taxation, tax procedures and international tax, as well as aspects of the tax advisor profession, namely its role and importance in Spain as a EU member state where it provides major support to companies. 7 Member: Confederation Fiscale Europeenne Romanian Association of Liberal Professions 10) Between 4 and 5 April 2009 the Romanian Chamber of Fiscal Consultants organised the second International Tax Seminar together with German experts, focusing on topics such as taxation in Germany, European taxation in the current context and prospects, as well as aspects of the tax advisor practice in Germany. 11) On 24 April 2009 the Romanian Chamber of Fiscal Consultants attended the proceedings of the Confédération Fiscale Européenne Council meeting and Extraordinary General Assembly, where a number of topics were approached, such as: a)Report of the Professional Affairs Committee on the activity between September 2008 and April 2009; b) Report of the Fiscal Committee on the activity between September 2008 and April 2009; c) Un-audited report (Un-audited financial statements) for the year ended on 31 December 2008; d)Proposition on a new membership fee system and exceptional fee (CFE investment – development) for 2009; e) European Register of Tax Advisers – changes in fee collection; f) News on the implementation of the Business Development Plan; g) Launch of the new CFE website; h) Approval of the Minute of the CFE Ordinary General Assembly proceedings held in Madrid on 26 September 2008; i) Approval of the 2009 budget revenues; j)Preparing the 50 th anniversary of the CFE, at the same time with the CFE Council meeting and Ordinary General Assembly, to be held in Paris on 26 September 2009. 8 Further to the one-on-one discussions with members of the CFE Superior Council and other CFE members, the Romanian Chamber of Fiscal Consultants was asked to present in the forthcoming period a new application for review of the CCF’s member status, and a synopsis of the Romanian Chamber’s achievements from 26 September 2008 (the date of the CFE Ordinary General Assembly when the adhesion of the CCFR observer membership was approved) to date, in order to address again the Romanian Chamber of Fiscal Consultants joining the CFE as a full member, at the Ordinary General Assembly of the CFE to be held in Paris on 26 September 2009. 12) The participation of the CCF Superior Council members – Ms. Mihaela Mitroi and Mr. Ionuţ Ştefan – in the proceedings of the International Forum, of the Professional Affairs Committee and of the Fiscal Committee organised by the Confédération Fiscale Européenne between 22 and 24 April 2009 at Brussels, with numerous wide interest discussions on the identification of common criteria defining the tax advisor profession, the assessment of the CFE member Code of ethics, the active cooperation between the CFE and the European Commission, as well as discussions on the G20 event where tax topics were addressed and on the new European directives on administrative cooperation and mutual assistance between Member States in the recovery of taxes. 9 on Improving the regulatory and administrative framework in the area of excise The first seminar on Improving the regulatory and administrative framework in the area of excise duties on tobacco and tobacco products, aimed at reducing market distortions duties on tobacco and tobacco products, aimed at reducing market distortions was organised in Bucharest by the Romanian Chamber of Fiscal Consultants together with JTI Romania and BAT Romania on 13 May 2009; officials with the central public administration were present, as well as representatives of the relevant industry and the media, aiming at finding the best solutions in the filed, while also publicising the good cooperation between the businesses and the public administration. the third 14) On 13 May 2009 the Romanian Chamber of Fiscal Consultants organised in Sibiu the third International Tax Seminar together with German experts International Tax Seminar together with German experts, with the Double Tax Treaty between Romania and Germany debated in detail, in terms of overall framework and case studies. The following German experts were speakers at the event: Dr. Hartmut Klein – lecturer, Federal Academy of Finance and Mr. Wilhelm-G Hietsch - Lawyer 13) The launch of a series of tax seminars, together with the large consulting firms in Romania, and with the Ministry of Public Finance officials, debating on tax aspects following the significant amendments to the Fiscal Code and Fiscal procedural Code (in force as of 1 January 2010). 10 15) On 29 August 2009 the Romanian Chamber of Fiscal Consultants organised in Constanţa the fourth International Tax Seminar together with experts from the UK, with topics such as taxation in the UK (overview of the tax laws, VAT treatment and corporate tax) and particularities in implementing the Double Tax Treaty between Romania and the United Kingdom of Great Britain and Northern Ireland – the Romanian and the UK perspective. Mr. Stephen Coleclough – President of the Confédération Fiscale Européenne was the special guest. The following topics were addressed: a)The UK tax system – Overview of the tax laws in the UK and Corporate Tax – speaker Ms. Tina Riches – Tax advisor in the UK, CIOT Technical Director, and Mr. Jim Fergusson – HMRC representative, Deputy Director of the team in charge of the Review of HMRC Powers; b)VAT treatment in the UK – speaker Mr. Stephen Coleclough – President of the Confédération Fiscale Européenne; c)Transposition of the “VAT package” into Romanian law – speaker Ms. Mariana Vizoli, Director – Directorate for VAT legislation, Romanian Ministry of Economy and Finance; d)Particularities in implementing the Double Tax Treaty between Romania and the United Kingdom of Great Britain and Northern Ireland – the UK perspective - speaker Mr. Stephen Coleclough, President of the Confédération Fiscale Européenne; e)The Double Tax Treaty between Romania and the United Kingdom of Great Britain and Northern Ireland – the Romanian perspective – speaker Ms. Mihaela Mitroi, President of the Tax Committee within the CCF. 11 26 September 2009 16) On 26 September 2009, following the proceedings of the Ordinary General Assembly (OGA) of the Confédération Fiscale Européenne held in Paris, in the light of the activity of the CCF representatives within the committees, commissions and assemblies organised by the CFE, as well as the CCF activity in international affairs, THE APPROVAL BY UNANIMOUS VOTE OF THE Romanian Chamber of Fiscal A FULL MEMBER of the Consultants ADHESION AS A FULL MEMBER of the Confédération Fiscale Européenne. The presentation in Paris before the OGA of the CFE on 26 September 2009 was an opportunity for the CFE representatives to acknowledge these achievements and vote accordingly. What carried much weight in the decision of the CFE OGA representatives to accept CCF as a FULL MEMBER was the intensive domestic activity and noticeable progress of the organisation in only 12 months from its CFE Observer status award. 12 17) On 9 November 2009 the Romanian Chamber of Fiscal Consultants organised in Bucharest the fifth International Tax Seminar together with Dutch experts, which proved a good opportunity for an exchange of information on the tax system and procedures in the Netherlands and Romania respectively, as well as the role of the tax advisor in the taxpayer - tax authorities relationship. a)How the Dutch tax law improved the business climate – speaker Mr. Jan Gooijer, Senior Tax Manager, PricewaterhouseCoopers Amsterdam; b)The Dutch authorities perspective on tax procedures and examples – speaker Mr. René Landgraf, Representative of the Rotterdam tax authority; c)The tax advisor – the essential link between taxpayers and tax authorities – speaker Mr. Henk Koller, Vice- president of the Professional Affairs Committee within the Confédération Fiscale Européenne; d)What a Dutch tax advisor does in Romania – speaker Mr. Peter de Ruiter, Vice-president of the Romanian – the Netherlands Chamber of Commerce and Industry. 14 19) The participation of Mr. Cosmin Ivănuş, Director of the National and International Relations Department, in the working party organised by the Extraordinary General Assembly of the Romanian Association of Liberal Professions held on 10 March 2010 (CCF is a member of the Romanian Association of Liberal Professions effective from 01 April 2008). 20) The participation of Mr. Daniel Chiţoiu – President of the Romanian Chamber of Fiscal Consultants and of Mr. Toni Teau – Vice-president of the Superior Council of the CCF in the proceedings of the Regional Forum “CFO’s International Conference / In times of crises – Money talks”, held in Bucharest between 16 and 17 March 2010. The purpose of the conference was to provide the best leadership practices to the attendees interested in the efforts to support the mechanisms of future development. The following topics were addressed: The following topics were addressed: a) what should be done to ensure genuine and sustainable economic growth; b) how CFOs can face market demands; c) how CFOs can counter the deficit of a flexible market; d) how a right mix can be reached between short –term priorities and long-term vision; e) bankruptcy or insolvency; f) practical solutions to cope with the downturn. 15 21) The second tax seminar, attended by the large consultancy firms in Romania and with Public Finance Ministry officials to debate on the tax aspects following the significant amendments to the Fiscal Code and Fiscal Procedural Code (in force as of 1 January 2010) was organised by the Romanian Chamber of Fiscal Consultants together with OMV Petrom in Bucharest on 25 March 2010, and was named “Energy products – finding the balance between tax burden and tax collection". The following topics were proposed for debate: Bonded warehousing for energy products – improvement propositions – speaker Ms. Irina Dobre – Tax Director, OMV Petrom; Domestic and intra-Community movement of energy products – speaker Mr. Cătălin Drăgan – Senior Councillor, Directorate for Excise duty legislation, Public Finance Ministry; Methods and practices to combat illegal trade in and counterfeiting of energy products – speaker Mr. Dan Pulbere – Head of Cabinet, National Customs Authority and Mr. Gabriel Cărbunaru – General Deputy Commissioner, Fuels and Mineral Oils Division, Economic Crime Unit. 16 22) Further to the cooperation protocol with the Romanian Chamber of Commerce and Industry, as well as with local Chambers of Commerce and Industry from various counties across the country, the Romanian Chamber of Fiscal Consultants focused on achieving a close relationship combining the expertise and experience of its tax advisor members and of the business environment representatives in each county. The first event in this series was organised by the Chamber of Fiscal Consultants together with the Chamber of Commerce and Industry from Mureş county in Târgu- Mureş on 15 April 2010. The topics proposed for debate were: the amendments to the Fiscal Code, in force as of 1 January 2010, in the direct and indirect tax areas, and the role and importance of tax consulting at present. By using state-of-the-art web-based technology, the Confédération Fiscale Européenne created and developed the European Register of Tax Advisers, that meets the requirements of anyone in search of a tax advisor. By accessing http://www.cfe-eutax.org/register you can easily find a European advanced search engine for a Qualified Tax Advisor. http://www.cfe-eutax.org/register Why should you enlist? In your capacity as a member of a CFE-affiliated organisation and given that you meet the CFE Code of Ethics and Professional Conduct, you are one of the highest qualified tax Advisors in Europe. A benefit of the Register is its being designed for advisors meeting the same qualifying criteria. Certainly there are more benefits: Being an on-line search engine, it can be used by prospective clients al over the world to locate an advisor with the appropriate professional skills. Clients can proceed by using the name, country, language skills or other specialty as search criteria. For instance, if you are a transfer pricing expert from Spain, and a native speaker of English, you can use the Register to promote your skills and abilities and thus attract new clients. 23) In April 2010 the implementation started of the procedures regulating the enlisting of Romanian tax advisors with the European Register of Tax Advisers, developed and updated by the Confédération Fiscale Européenne. 18 24) The participation of Ms. Mihaela Mitroi – President of the Tax Committee, and of Mr. Ionuţ Ştefan – member of the Superior Council of the CCFR, in the proceedings of the Professional Affairs Committee and of the Fiscal Committee, organised by the Confédération Fiscale Européenne in Brussels between 14 and 16 April 2010, with numerous wide interest discussions on direct and indirect taxes across Europe and the activity of the Committee for Professional Affairs under the CFE; the topics addressed by the committees are subsequently analysed within the Tax Committee under the Romanian Chamber of Fiscal Consultants which comprises number of tax advisors who are CCF members. 25) The participation of Mr. Daniel Chiţoiu – President of the Romanian Chamber of Fiscal Consultants and of Mr. Toni Teau – Vice-president of the Superior Council of the CCF in the proceedings of the International INFORMATION ACROSS BORDERS in Indirect and Direct Tax Forum “INFORMATION ACROSS BORDERS in Indirect and Direct Tax” held on 15 April 2010 where interesting topics were discussed, on the developments in the implementation of the Global Standards on Information Exchange – the OECD and European Commission perspective, and an inter-state comparison of the International exchange of direct tax information made by 3 experts, from Belgium, Luxembourg and Switzerland respectively, in terms of specific law in each of the countries. The topic of the Exchange of indirect tax information, particularly VAT, was debated in detail. It was the same persons who ensured CCF’s participation in the Extraordinary General Assembly and Council meeting of the CFE on 16 April 2010, organised by the Confédération Fiscale Européenne in Brussels. It was the first assembly where the CCF had a voting right. The topics on the agenda were the approval of the minutes of the Ordinary General Assembly of the CFE held in Paris on 26 September 2009, the presentation of he un-audited financial statements of 2009, the approval of the CFE 2009 budget, the presentation and approval of the new individual contributions to the CFE budget, broken down per full member or observer-status member of the CFE. 19 General Assembly and Council meeting of the CFE held inBrussels on 16 April 2010 26) During the same Extraordinary General Assembly and Council meeting of the CFE held in Brussels on 16 April 2010 the new membership fee system was approached. The criteria used for calculation of the contributions were: - country population - number of professionals - gross domestic product (GDP) – according to World bank statistics - budget of each member organisation - combination of criteria: e.g. Number of professionals: 50%; GDP: 20 %; Number of inhabitants: 30% - minimum fixed fee + contribution proportional to the number of professionals - minimum fixed fee + contribution proportional to the number of professionals + GDP based contribution Objectives achieved: A Country Approach : Membership fees are calculated on a country basis, whatever the number of organisations representing the country; Independence : CFE must not be to dependent upon one country. We are of the view that one country should not be responsible more than 20% of our cash needs; Soft contributions should be recognised; Each country should pay a minimum contribution which should be meaningful; Observers should also pay this minimum contribution; The new contribution system must allow CFE to cover its costs, in order to: - maintain a high quality service in Brussels; - enhance its relationship with the European Commission; - allow the development of the work performed by the Tax committee, the Professional Affairs Committee and the ECJ Task Force and; - restore its financial position. 20 The new contribution model creates a transparent fair system that takes into account the financial capacities of each organisation. the overall base and gross domestic product (GDP) for 2010 were established at 250.000 and will be increased/lowered in the event of a large number of (new) members joining /leaving. Country calculations will be re-gauged for 2011 and 2012 to consider the number of members and the budgets of member organisations. the minimum contribution /observer fee was established at EUR 2,000. all fees are country fees; cost sharing between several member organisations will be left at the discretion of the organisations. the new contribution system will be gradually implemented in 2010, 2011 and 2012, when no reduction from the current rates will be granted to the former 10 largest members. the German contribution of EUR 86,332 reflects the financial contribution of the German Chamber of Tax Advisers (BStBK), paid by the Chamber for the General Secretariat (known as a “soft” contribution because it is borne rather than paid directly to the CFE). 21 27) Further to the Cooperation protocol with the Romanian Chamber of Commerce and Industry the second event was organised together with the Chamber of Commerce and Industry Suceava, held in Suceava on 3 June 2010, where the business representatives in the Suceava county and tax advisors together with specialists of the Ministry of Public Finance and General Directorate for Public Finance Suceava exchanged information on the difficulties encountered in implementing the tax law, finding solutions to do away with the problems, and presented the latest developments in the field. During the meeting the local tax advisors particularly stood out, showing a high level of professionalism in approaching topical subjects in terms of both tax law and tax procedures. During the same meeting the organising by the Romanian Chamber of Fiscal Consultants of the Ordinary General Assembly of the Confédération Fiscale Européenneon 21 September 2012 was approved by unanimous vote. 28) The participation of Mr. Daniel Chiţoiu – President of the Romanian Chamber of Fiscal Consultants and of Mr. Toni Teau – Vice-president of the Superior Council of the CCF in the meeting of the Ordinary General Assembly (OGA) of the Confédération Fiscale Européenne held in Prague on 24 September 2010. One of the main items on the agenda was the change of the voting system (effective from 2012). Other topics were the approval of the minutes of the Extraordinary General Assembly and Council meeting of the CFE held din Brussels on 16 April 2010; the amendments to the CFE Statutes; the activity of the Professional Affairs Committee and Fiscal Committee within the CFE during April to September 2010; the presentation of the CFE Annual Report 2009/2010; the presentation of the financial statements for 2010; the presentation and approval of the 2011 budget; the presentation of the report on the implementation of the project “The Future of the Confederation Fiscale Europeenne”. 24 31) On 28 October 2010, the Romanian Chamber of Fiscal Consultants organised in Cluj- Napoca the seventh International Tax Seminar, Romania-Hungary. Numerous Romanian and Hungarian tax advisors attended the seminar, as well as business representatives – Hungarian-participation companies and joint ventures from Romania and Hungary. Prominent academics with the Babeş-Bolyai University in Cluj-Napoca attended, as well as the local media, members of the Superior Council of the respective Chambers of tax Advisors from Romania and Hungary. The seminar topics brought to the attendees' attention the Hungarian tax system, aspects of the tax advisor profession – the role and importance of this profession in the two states. The event was held under the aegis of the special friendship and cooperation relationships between Cyprus and Romania, and the size of the Romanian-Cypriot trading over the last couple of years. 31 43) The participation of Ms. Florentina Şuşnea – Vice-president of the CCF Superior Council in the proceedings of the International Forum on “PERMANENT ESTABLISHMENT in Direct and Indirect Tax”, organised by the Confédération Fiscale Européenne in Brussels on 7 April 2011, where matters related to the OECD Model Convention, the new European Directive on value added tax and the EU-wide implementing regulations were discussed. The representatives of the Superior Council of CCF also attended the proceedings of the Fiscal Committee - Indirect Taxes (Ms. Florentina Şuşnea) and Direct Taxes (Mr. Ionuţ Stefan) held on 8 April 201. 44) The participation of Mr. Daniel Chiţoiu – President of the Romanian Chamber of Fiscal Consultants and of Mr. Toni Teau – Vice-president of the CCF Superior Council in the meeting of the Ordinary General Assembly (OGA) of the Confédération Fiscale Européenne (CFE) that took place in Brussels on 8 April 2011 was aimed at leading to the establishment of a new Brussels-based CFE organization to include the Romanian Chamber of Fiscal Consultants as a founding member. Other topics debated on included: the approval of the minutes of the Extraordinary General Assembly on 24 September 2010 in Prague; the presentation of the un-audited financial report as at 31 December 2010; the presentation of the 2011 financial statements; the reports of the Professional Affairs Committee and Fiscal Committee within CFE for the period September 2010 to April 2011. Taxpayer’s Charter As part of the same meeting, Mr. Stephen Coleclough, CFE President, submitted details on “Taxpayer’s Charter” – a global project performed in cooperation with the AOTCA (the Asian and Oceanic Tax Consultants Association) and STEP (the Society of Trust and Estate Practitioners), that is aimed at developing a charter on the taxpayers’ rights and responsibilities to tax administrations.
