M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union National legislation in Montenegro is not in full complience with the provisions of the Directive. Mining activities in Montenegro are regulated by the Mining Law (“Official Gazette of Montenegro”, 65/08, 74/10, 40/11) regulating inter alia: -the conditions and method of extraction of mineral resources, -safety at work, -environmental protection measures during execution of mining operations, -other importanta issues regarding extraction of mineral resources. The procedure for managing mining waste is regulated under mining design, including design solutions for waste management facilities, Chapter 27: Environment and climate change Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union According to the existing laws, the conditions and measures that are implemented in order to protect against water, air and soil pollutation are foreseen in the design phase of the Mining Project, for which an assessment of impacts on the environment is subsequently carried out through the development of Environmental Impact Assessment Mining facilities, including facilities for waste management shall be subject of inspection prior to use. Pursuant to the Mining Law, the concessionaire shall, during and after the completion of works on the extratction of mineral resources, and no later than one year from the date of completion, bring the land on the mining field into use, according to the land reclamation project, or to take environmental protection measures contained in the Environmental Impact Assessment. M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union A longer period of time is necessary for transposing the Directive to national legislation For transposing the Directive it is necessary to created the institutional and legal framework, i.e., it is necessary to identify : - the authority that will execute the powers provided by the Directive, - the law transposing the Directive. A number of laws (on mining, waste management and production of hydro carbons) that may transpose the Directive are mutually exclusive or do not apply to waste from extractive operations. The Mining Law does not relate to all waste management facilities that are covered by the Directive Chapter 27: Environment and climate change Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Identification and the method for licensing category A waste management facilities was not done in accordance with the procedure defined in Directive No competent authority that performs powers under Directive especially in the part relating to the licensing, organization and conduction of inspections and reporting obligations has been identified Providing progressive coverage of all plants by financial guarantee has not been fulfilled Montenegro does not have an inventory of abandoned waste management facilities. M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Montenegro has significant amounts and types of mineral raw materials including energy resources, metal and non-metal raw materials, etc. The most important exploited mineral raw materials include coal, red bauxite, lead and zinc.
