Criminal Case Procedure
Step 1 Arresting a Suspect Probable cause is needed. Miranda rights are read. Taken to Police Station Booked (charged with a crime), photographed, fingerprinted, and phone call made.
Step 2 Initial Court Appearance Magistrate (Judge) hears charges. Magistrate (Judge) sets bail or sends the accused back to jail to await trial.
Step 3 Arraignment Probable cause is reviewed. Defendant may have a court appointed lawyer. Accused enters plea. Court date is set. Plea-bargaining begins. (Most cases are settled this through plea bargaining)
Step 4 Trial Jury is selected. Prosecution presents first. Opening statements made. Witnesses are called, testimony Closing Statements. Verdict.
If Guilty, then sentencing based on the crime and criminal history. Step 5
