Texas Law Enforcement Best Practices Mid Year Training Conference

 Property and Evidence Management is one of the most troublesome areas for law enforcement agencies.  Requires constant attention.  Must be done absolutely correctly to ensure evidentiary chain of custody.

 Three main types of Property  Evidence – must be kept secure to prevent inappropriate tampering and must have clear Chain of Custody.  Found Property  Safekeeping  Your are still responsible for the security of these items!

 Recognition Program Standards designed to ensure proper management.  Many other ideas for better management of property and evidence can be implemented.  Recognition standards provide only the very basics of what is needed for Texas Property and Evidence facilities.

 Recognition Program Standards relating to Property and Evidence are found in Chapter 12  Eight standards  All are Required Standards for all agencies

 Property and Evidence – Chain of Custody (V)  The Agency has a written directive for taking property/evidence into custody, including assets seized for forfeiture, to insure proper inventory, storage, and chain of custody.

 This standard requires that you have a clearly written policy on when property and evidence is taken into custody, how it is processed, secured, documented, and how the chain of custody is maintained.  It also applies to items seized for purposes of forfeiture.

 Access to Crime Scene Technicians (EV)  The Agency has on staff, or has access to, trained crime scene technicians to assist with major crime investigations when necessary.

 Property/Evidence Submission (E)  The Agency has a written directive that requires all property/evidence seized by agency personnel to be submitted to the property/evidence technician or placed in the property/evidence area by the end of their tour of duty. Employees shall not personally retain property or evidence, except as part of an authorized chain of custody.

 Property/Evidence Storage Area Security  The Agency authorizes by written directive, personnel who can enter the Property/Evidence storage area. The Property and Evidence storage area will be secure and access will be restricted for any unauthorized personnel unless they are escorted, and sign in and out on an access log or other type of tracking system.

 Property/Evidence Storage Area Security  What is “secure?”  Ability for custodian to become immediately aware of an unauthorized entry.  Doors  Walls  Ceiling

 Disposal of Property/Evidence (V)  The Agency has a written directive for the documentation of the disposal of property/evidence stored in the Agency property/evidence storage area.

 Field Release of Property (E)  The Agency has a written directive for the release of property or evidence in the field. The policy should detail when and how items may be released to the complainant or owner when practical without compromising a case. All releases will be documented and signed for on a property/evidence release form.

 Inspection of Property/Evidence (EV)  The agency has a system in place for a documented inspection of the Property/Evidence function and procedures at least every six months. An inspection should concentrate on how the policies, procedures, and practices are followed and have minimal individual inspections of items to verify procedures.

 Inspection of Property/Evidence (EV)  Every 6 months  Proof must show that inspector reviewed the policies, procedures, and practices, and whether they were being properly followed.  Should include information about security, cleanliness, orderliness, proper storage of items, and ability to locate selected items (5-6).

 Inventory of Property/Evidence (EV)  The Agency has a written directive requiring a sampling of individual items stored in the property and evidence area at least annually, and when a new person is assigned who is in direct control of the property/evidence function. The sample must meet the requirements for sampling in Appendix A

 Inventory of Property/Evidence (EV)  Three Inventory Methods approved:  100% of all items stored.  100% of Money, Guns, and Drugs and at least 50 other items at random.  Statistical Random Sampling  Appendix A description and chart
