When a driver’s car is hit from behind, regardless of the reason it is usually deemed to be the fault of the driver who hit the car in the rear. This is because: A driver must be able to come to a safe stop if the vehicle(s) ahead stops or slows down. If the driver cannot come to a safe stop, it indicates that he/she is not driving in a safe speed.
