Background In 1996 was created the Rapporteurship on the rights of migrants and their Families in the IACHR Over the years, the Commission has been following up on the main challenges facing by asylum seekers, refugees and persons in the need of complementary protection in human rights and international refugee law. It has done, among others, the following reports: – Report on the Situation of Human Rights of Asylum Seekers in the Canadian System Framework Determining Refugee Status; – Report in the Access to Justice and Social Inclusion: The Road towards Strengthening Democracy in Bolivia;

Additionally, the Rapporteurship undertakes visits to OAS member status in order to monitor in situ the conditions of migrant workers and their families: – United States (1998) – Canada (2000) – Guatemala (2003) – Mexico (2003) – Costa Rica (2003) Following a specific mandate advanced by the Heads of States and Government during the Third Summit of the Americas and a Specific Resolution by the OAS General Assembly (AG/RES (XXXIII-O/03), the Special Rapporteurship actively participates in the discussion and preparation of an Inter-American Program for the Protection and Promotion of the Human Rights of Migrants. THE HUMAN RIGHTS OF ALL MIGRANT WORKERS AND THEIR FAMILIES CP/CAJP-1802/01 - AG/RES (XXXI-O/01) RESOLVES: 6. To request the Permanent Council, in accordance with the provisions of the chapter on migration in the Plan of Action of the Third Summit of the Americas, to: a. Study the adoption of measures designed to strengthen cooperation among states to address, with a comprehensive, objective, long-term approach, the manifestations, origins, and effects of migration in the region, as well as promote close cooperation among countries of origin, transit, and destination so as to ensure the protection of the human rights of migrants; and b. Prepare an inter-American program for the promotion and protection of the human rights of migrants, with the assistance of the appropriate organs and agencies of the inter-American system and of the United Nations. 7.To invite the Inter-American Commission on Human Rights (IACHR) and the Inter-American Agency for Cooperation and Development (IACD) to consider the advisability of adopting joint cooperation programs in this area, taking into account the work done by other organs, agencies, and entities, such as the International Organization for Migration (IOM) and the International Labour Organization (ILO). 11. Recapitulation Migration has been addressed in the OAS since longstanding prevailing the technical approach, in line with comments made by Member States in the last resolution adopted in Cochabamba The issue within the organization is enhanced by the creation of the Inter-American Program for the Promotion and Protection of Human Rights of Migrants through its resolution AG / RES (XXXV-O/05) on June 7, 2005 which aims to promote the development of public policy, legislation and best practices for the protection of human rights of migrants. Two years later, in 2007, establishing the Special Committee on Migration Issues, whose purpose is the analysis and understanding of migration flows in the hemisphere.

With the creation of the CAM, by resolution AG / RES (XLII-O/12) the topic is institutionalized in the organization. Its main lines, among others, are: the comprehensive, balanced and technical, the importance of dialogue, the exchange of best practices and the implementation of cooperation initiatives, and the dignity of the image of migrants in their countries of residence image.
