Turkey’s Experience on the Accession to ADR Convention (Lessons Learned) 23-25 August 2015 Kabul/AFGHANISTAN

Turkey’s Experience on the Accession to ADR Convention Turkey became a party to the European Agreement on International Carriage of Dangerous Goods by Road (ADR) on 22 March 2010 Türkiye 22 Mart 2010’da Tehlikeli Malların Karayoluyla Uluslararası Taşınmasına Dair Avrupa Sözleşmesi’ne (ADR) taraf olmuştur. Turkey became a party to the European Agreement on International Carriage of Dangerous Goods by Road (ADR) on 22 March 2010.

Turkey’s Experience on the Accession to ADR Convention Ratification Process 2004 2010 The ratification process takes part in three main stages. Procedures to be completed at the Ministerial Level, at the Parliament level, at Prime Ministry Level (Council of Ministers). The ratification process consists of 3 main stages. These are the procedures that has to be completed at the Ministerial level, Parliement level and Council of Ministers level Onay/İmza süreci üç temel aşamadan oluşur. Bunlar, Bakanlık düzeyinde, Meclis düzeyinde, Başbakanlık düzeyinde (Bakanlar Kurulu), tamamlanması gereken işlemlerden oluşur.

Turkey’s Experience on the Accession to ADR Convention First Stage Whole text translated into Turkish language by the relevant Ministry, Six approved copies are send to Ministry of Foreign affairs, Checked by Legal Affairs Department, Submitted to the Turkish Grand National Assembly (TGNA) with justification to be discussed at Sub Commissions (Transport and Foreign Affairs commissions) At the First Stage Whole text translated into Turkish language by the relevant Ministry, (Translation took our lots of time in order to keep the unity within its structure consisting huge volume of text and technical terminology and definitions ) Authorised six copies delivered to the Ministry of Foreign Affairs Checked by the Legal Affairs Department Submitted to the Turkish Grand National Assembly (TGNA) with justification to be discussed at Sub Commissions (Transport and Foreign Affairs commissions) And forwarded to the parliement for authorisation/ratification Birinci aşamada, Bütün metin ilgili Bakanlık tarafından Türkçe diline çevrildi,, (Büyük hacimde bir metin olması ve teknik terim ve tanımların bütünlüğünün sağlanması açısından tercümesi çok zamanımızı aldı.) Onaylı altı kopya Dışişleri Bakanlığına gönderildi, Hukuki İşler Dairesi tarafından kontrol edildi, Türkiye Büyük Millet Meclisine (TBMM) gerekçeleri Alt Komisyonda görüşülmek üzere sunuldu(Ulaştırma ve Dış İşleri Komisyonu) Buradan da Parlementoya (TBMM) onay için gönderildi.

Turkey’s Experience on the Accession to ADR Convention Second Stage submitted to approval of Parliament (TGNA) the law for accession to Agreement is ratified by Parliament (and published in the Official Gazette) Second stage, the Law for accession to the (ADR) was ratified by Turkish Grand National Assembly on 30 November 2005 and was promulgated in the Official Journal on 6 December 2005 (Law No: 5434). İkinci Aşamada, (ADR)’ katılım kanunu Türküye Bütük Millet Meclisinde 30 Kasım 2005’de onaylandı ve 6 Aralık 2005 tarihinde Resmi Gazete’de ilan edildi (Kanun No:5434)

Turkey’s Experience on the Accession to ADR Convention Third stage…. The Directorate General for Laws and Decisions under the Prime Ministry, checks the translated texts for punctuation, unity and spelling errors. If necessary, remarks, improvements and corrections could be made at this stage. The legal text is send to the Council of Ministers for decision to be published in the Official Gazette. At this stage Agreement Text is reviewed by the experts of the Prime Ministry Directorate General for Laws and Decisions and it has been decided to evaluate the text in order to obtain the unity, consistency, and correct the mistakes. After this Annex A and B has been reviewed and improved by an administrative committee established under the Ministry of Transport. Text has been reviewed and improved once again by the suport of our Union After the decision made by the Council of Ministers, ADR Annex A and B was published in the Official Gazzette on October 30, 2009 Üçüncü aşamada…. Başbakanlık altında Kanunlar ve Kararlar Genel Müdürlüğü tercüme edilen metni yazım, bütünlük ve imla hatalarına karşı kontrol eder. Eğer gerekliyse, uyarı, geliştirme ve düzeltmeler bu aşamada yapılabilir. Hukuki metin Resmi Gazete’de yayınlanmak üzere Bakanlar Kurulu’na gönderilir. Bu aşamada Sözleşme metni Başbakanlık, Kanunlar ve Karalar Genel Müdürlüğü uzmanları tarafından gözden geçirildi ve metnin bütünlüğü/birliğinin sağlanması kapsam, tutarlığı ve hataların düzeltilmesi vs gibi sebeplerle metnin geliştirilmesine karar verildi. Bunun üzerine, A ve B Ekleri UDHB bünyesinde kurulan bir İdari Komite tarafından gözden geçirilerek geliştirildi. Birliğimizin de desteği ile metin tekrar gözden geçirilerek iyileştirildi. ADR Sözleşmesinin A ve B Ekleri Bakanlar Kurulu kararının alınması sonrası 30 Ekim 2009’da Resmi Gazete’de yayımlandı.

Turkey’s Experience on the Accession to ADR Convention For shorten the ratification process…finding a new possible way.. We have submitted the “1993 Protocol” to the Parliament, to be ratified with a law. But we have asked for decision of Parliament to give Authority to the Council of Ministers for approving and publishing the amendments made to ADR Annexes A and B (every 2 years), in the Official Gazette without a Parliamentary decision. By this way, we expect to respond more quick to harmonize the amendments to our national legislation. There is another way to shorten the period that is elapsing during the ratification of the agreement procedure by the perliement Ammendement of the 1993 protocole of the ADR agreement is ratified by the parliement By courtesy of this, ammendements to Annex A and B of ADR will be in force following the decision of Council of Ministers Sözleşmenin parlemontadan geçirilerek yayımlanması sürecini kısaltmanın başka bir yolu var. ADR Sözleşmesini tadil eden 1993 protokolü parlemontadan geçirilir. Bu sayede ADR’nin A ve B eklerinde yapılan değişiklikler her iki yılda bir Bakanlar Kurulu kararı ile yürürlüğe konur.

Turkey’s Experience on the Accession to ADR Convention The ADR is a multidisciplinary agreement, involving several institutions like; Ministry of Transport; the competent authority, regulating, coordinating, monitoring the impl. of ADR, Ministry of Interior; responsible for road-side checks, Ministry for Industry and Trade; responsible for type-approval and testing of road vehicles and pressurized tanks, Ministry of Environment and Forestry; responsible for disposal of hazardous materials, safety guides and forms. Ministry of Health/ Ministry of Agriculture; Toxic and infectious substances (Class 6) Ministry of Energy (TAEI) ; Radioactive materials (Class 7) The ADR is a multidisciplinary agreement, involving several institutions like; Ministry of Transport; the competent authority, regulating, coordinating, monitoring the impl. of ADR, Ministry of Interior; responsible for road-side checks, Ministry for Industry and Trade; responsible for type-approval and testing of road vehicles and pressurized tanks, Ministry of Environment and Forestry; responsible for disposal of hazardous materials, safety guides and forms. Ministry of Health/ Ministry of Agriculture; Toxic and infectious substances (Class 6) Ministry of Energy (TAEI) ; Radioactive materials (Class 7) ADR aşağıdakiler gibi bir çok kurumu dahil eden çok disiplinli bir sözleşmedir; Ulaştırma Bakanlığı; ADR’nin uygulamasını düzenleyen, koordine eden, izleyen yetkili makamdır, İçişleri Bakanlığı; yol kenarı denetimlerinden sorumludur, Sanayi ve Ticaret Bakanlığı; karayolu taşıtları ve basınçlı tankların tip onayları ve testlerinden/muayenelerinden sorumludur, Çevre ve Orman Bakanlığı; tehlikeli atık maddelerden, güvenlik rehberleri ve formlarından sorumludur, Sağlık Bakanlığı/Taşım Bakanlığı; Zehirli ve bulaşıcı maddelerden sorumludur (Sınıf 6), Enerji Bakanlığı(TAEK) ; Radyoaktif maddelerden sorumludur. (Sınıf 7)

Turkey’s Experience on the Accession to ADR Convention ROAD New (By-Law) National Regulation was prepared which is in line with ADR and the EU Directives. Turkey’s Experience on the Accession to ADR Convention National regulations 2007 – 2013 Determination of Competent Authority and Stakeholders eventually task sharing (TMKT- Dangerous Goods and Combined Transport General Diroctirate- TSE-Turkish Standards Institute – Relevant Ministries -Türk Loydu Foundation) Consultation and informative meetings First national regulation about the transport of dangerous goods was made on 2007. But in order to get the adaptability of the sector, its date of effect was extended untill 2009 first, and then extended untill 2011. Also in 2010 its date of effect is extended until 2014; by measn of transition period; provisions on labelling, marking and packaging implementation date was declared as 1 January 2012, provisions that the road vehicles have to meet declared as to be effective until 1 January 2013. Within this period, evaluations have been made among the stakeholders of the sector, task sharing was made and infotmative meeting organized by partnership with NGOs. Tehlikeli maddelerin taşınması konusunda yapılan ilk ulusal düzenleme 2007 yılında gerçekleşmiştir. Ancak sektörün uyum sağlayabilmesi için yürürlük tarihi önce 2009 yılına kadar, sonra 2011 yılına kadar uzatılmıştır. 2010 yılı tarihinde ise yürürlük tarihi 2014 yılı başına ertelenmiş; işaretleme, etiketleme ve paketleme ile ilgili hükümlerinin uygulaması için 1 Ocak 2012 tarihine, karayolu araçlarının ve taşıma birimlerinin sağlaması gereken şartlar için 1 Ocak 2013 tarihine kadar geçiş süreleri belirlenmiştir. Bu süre içerisinde sektör paydaşlarıyla değerlendirmelerde bulunulmuş, görev paylaşımı yapılmış ve STK’lar ortaklığıyla bilgilendirme toplantıları düzenlenmiştir.

Turkey’s Experience on the Accession to ADR Convention National regulations 2013 – 2015 Competent authority is in charge, Completion of training of trainers, Continueing to informative seminars, Dangerous Goods Platform established withinTOBB, The technical support was received under EU financed Projects (Service, Twinning and TAIEX) during this period…. is an on going process. After being a contracting party of ADR, A General Directorate was established in order to carry out transport of dangerous goods for all modes of transport from one hand. After this first regulation was published in 2013 and partial implemetation was allowed for all stakeholders. According to this; In order to authorise with licence for all vehicles, they are permited untill 2018, Curent pressure equipments are allowed to use if they have passed certain tests just in case passing certain tests Legal entities and natural entities who are active in the sector are allowed for licencing/certification untill the end of 2014 Tunnel categories and codes system is declared to be completed untill the end of 2015 Declaring the itinaries and accomodation points as parking places etc of the road vehicles is decided to be completed by the end of 2015 Packagings that are manufactured before 2013 are allowed to use domestically untill the end of 2015 Within this period, training of the trainees who are going to traing drivers and safety advisors completed, education centers are authorised and training of the relevant persons is compelted Within this process also technical support is taken from EU funded projects 2010 yılında ülkemizin ADR sözleşmesine taraf olmasıyla beraber bütün taşıma modlarındaki tehlikeli yük taşımacılığının tek bir elden yürütülmesi amacıyla, bir genel müdürlük kurulmuştur. Bundan sonra yapılan ilk düzenleme 2013 yılında yayımlanmış ve tüm paydaşların uyum sağlayabilmesi için aşamalı geçişlere imkan sağlanmıştır. Buna göre; - Tüm taşıtların lisanslanması için taşıt model yılına bağlı olarak 2018 yılı sonuna kadar süre verilmiş, Mevcut taşınabilir basınçlı ekipmanların belirlenen testlerden geçmiş olması şartıyla kullanımına izin verilmiş, Sektörde faaliyet gösteren gerçek ve tüzel kişilerin belgelendirilebilmesi için 2014 yılı sonuna kadar süre verilmiş, ADR mevzuatı gereğince istihdam edilmesi gereken güvenlik danışmanlarının temini için 2015 yılı ilk yarısı sonuna kadar süre verilmiş, Tünel kategorilerinin belirlenmesi ve işaretlenmesi için 2015 yılı sonunda tamamlanması hüküm altına alınmış, Taşıma araçlarının izleyeceği güzergahlar ve konaklama noktalarının belirlenmesi için 2015 yılı sonunda tamamlanması hüküm altına alınmış, 2013 yılından önce üretilen ambalajların 2015 yılı sonuna kadar yurtiçinde kullanımına izin verilmiştir. Bu süreç zarfında, gerek güvenlik danışmanı gerekse araç sürücülerinin yetiştirilmesinde eğitici olarak görev yapacak kişilerin eğitimleri tamamlanmış, eğitim kurumları belirlenmiş ve ilgili kişilerin eğitimleri tamamlanmıştır. Bu süreçte teknik destek AB kaynalı projelerden alınmıştır.

Turkey’s Experience on the Accession to ADR Convention From our experience; We think that different Consulting Committees should be established to work on the specific subjects such as Classification of the dangerous goods and loading/unloading rules Packaging of the dangerous goods, production and approval of the packages Approval, testing, periodic inspection of the vehicles and other technical transport units Class 1-Explosive substances and articles Class 7-Radioactive material Class 6.2-Infectious substances Trainings Routes, parking areas Derogations Evaluation of the risks and the accidents Translation/checking of ADR and latest Annexes by committee Each Consulting Committee should consist of different experts from various institutions like public institutions, private sector, stake holders, universities. A Steering Committee which supervises all Consulting Committees. Obviously, all of these activities require technical and political commitment, sufficient time and staff. From our experience; We think that different Consulting Committees should be established to work on the specific subjects such as; Classification of the dangerous goods and loading/unloading rules Packaging of the dangerous goods, production and approval of the packages Approval, testing, periodic inspection of the vehicles and other technical transport units Class 1-Explosive substances and articles Class 7-Radioactive material Class 6.2-Infectious substances Trainings Routes, parking areas Derogations Evaluation of the risks and the accidents Translation/checking of ADR and latest Annexes by committee Each Consulting Committee should consist of different experts from various institutions like public institutions, private sector, stake holders, universities. A Steering Committee which supervises all Consulting Committees.Obviously, all of these activities require technical and political commitment, sufficient time and staff. Bizim tecrübemizden; Çeşitli konularda çalışmak üzere farklı Danışma Komitelerinin kurulması gerektiğini düşünüyoruz, örneğin; Tehlikeli malların sınıflandırması ve yükleme/boşaltma kuralları Tehlikeli malların paketlemesi, paketlerin üretim ve onaylanması Araçların ve diğer teknik taşıma ünitelerinin onaylanması, test edilmesi, periyodik muayeneleri Sınıf 1-Patlayıcı maddeler ve nesneler Sınıf 7-Radyoaktif maddeler Sınıf 6.2-Bulaşıcı maddeler Eğitimler Güzergahlar, park alanları Muafiyetler Kazaların ve risklerin değerlendirilmesi ADR ve güncel eklerin tercüme/kontrolünün komite tarafından yapılması Her Danışma Komitesinin kamu kurumları, özel sektör, paydaşlar, üniversiteler gibi çeşitli kurumlardan farklı uzmanlardan oluşması gerektiğini düşünüyoruz. Our Target To implement ADR completely to national legislation To implement regulations country-wide To implement regulations for transport of Dangerous Goods to all transport modes (Land, Sea, Rail, Air) Our target and wish ADR Agreement to be impelemented completely to our national regulations, and obtain the sustainability and country wide effectiness as well as a unified attitude to implemet to all modes of transport of dangerous goods. Bizim hedefimiz ve arzumuz; ADR Sözleşmesinin tamamiyle ulusal mevzuatımıza uygulanması, düzenlemelerin tüm yurtta fiilen uygulanması ve devamlılığının sağlanması ve tehlikeli madde taşımacılığıyla ilgili düzenlemelerin tüm taşıma modlarına yayılması ve uygulamada birlik sağlanmasıdır.
