First question to ask yourself: Is the user authorized? Student University/college researcher Professor University/college staff member

Second question: Is the use authorized? Teaching Research Planning of academic or educational services Not authorized: Sharing data outside of the DLI member institutions Using DLI data for contractual projects Users publishing textbooks must obtain a separate license – this is supported by StatCan

Scenarios for discussion In the following scenario, identify whether the situation falls within the DLI license or not. What are the key issues and what do you use to guide your decision?

Scenario #1 The moment that Julia walked into the department, you broke into a wide smile—she is one of the brightest education students with whom you’ve worked and you attended her graduation only a few months ago. After catching up on her current job with the provincial teacher’s association, Julia asks if you can help her download the most recent NGS file.

Scenario #1 She is on the program for a conference on education, sponsored by Statistics Canada, and wants to update one of the chapters in her thesis on urban-rural school leavers. Her PIN no longer works though, and if you could write the file to CD-ROM, that would be terrific— she’s always appreciated the help you’ve given her.

Scenario #2 Professor Watkins at Boyko University, a good and loyal data user with whom you have a good relationship based on a long history of data use, mentions over coffee that her book on using data in the classroom is almost ready to be sent to the publisher. She smiles engagingly and says that you will be mentioned in the acknowledgements for providing all those great data sets used in the examples in the textbook.

Scenario #2 As she offers to top up your coffee and puts a cherry Danish in front of you, she mentions that it is remarkable how technology has changed the teaching world. She can now include a CD-ROM with datasets used in the book, though having the data sets available on the publishers website is also sure to please students.

Scenario #3 The technical wizard at the Research Data Centre which is supported in large part by the Humphrey Research Institute, an affiliate institute of the university, sends you an asking for all of the census geography files at all levels of geography in both MapInfo and ArcInfo formats. He’d like them on CDROM--when can he pick them up?

Scenario #4 A graduate student is working with one of the researchers at the hospital and wants to know if she can use DLI data from CCHS to co- author a paper with Dr. Godfrey.

Data use no-nos Contractual, or income-generating activity Identification or disclosing information about any person, business or organization Redistribution outside the DLI institution

Scenario #5 Your relief lasts two weeks. You walk in on Tuesday morning to find an request for him asking for off-site download instructions for your web site. And, by the way, he has decided to work with the Canadian Travel Survey now; can you load those up on the website now?

Scenario #6 It is a hot summer day when a group of excited high school students approaches the desk for assistance with a question on financial ratios for the wheelchair industry. You hesitate—you know that the Financial Performance Indicators for Canadian Businesses can help but that is a DLI product. Can these students be helped?

Scenario #7 The nursing students are doing a report on the nature of the communities that would be affected by a disaster at a local nuclear plant. This is a partnership program where, rather than working on theoretical applications, the nurses work with a community organization on a particular health problem.

Scenario #7 The report from the clinical nursing group will go to NBPower. Can the students use the Census data and corresponding geographical files at the DA level?

Scenario #8 Professor Vincent is new to the campus and will be teaching a course for the Health Economics Research Institute, a newly created virtual tri-university teaching/research initiative between Boyko University, Watkins University and Humphrey University..

Scenario #8 He sends you an introducing himself and describes the course, and then asks if he can have the Health Promotion Survey to put on his WebCT site. Only students registered for the course will be able to have access to it.

Questions to ask yourself What is the issue?  Multi-university use with web technology Is the user authorized?  Are all the students (end users) authorized? Is the use authorized?  Distribution with other institutions Is there a ruling on this?  Ask

When in doubt… Consult the DLI Licensing Questions and Decisions section of the DLI website Use the drop down list to locate a scenario that might be close to yours If still in doubt, send a message to the dlilist Marie-Claire and Michel will respond If required, the EAC executive will discuss and reach a conclusion If declined, you can appeal to the EAC for a review

Don’t forget! StatCan must be cited  Consult: How to Cite Statistics Canada Products ( XWE) There are other routes to get data! Appeals can be made to the EAC

Need More? Scenario #9 You are the backup for the DLI Contact, who is now off in the mind-boggling world of Disneyland. Though you hope against hope that there will not be any difficult questions before her return, a shadow crosses your desk. There is a Research Data Centre at your institution and you have not yet had time to go over to introduce yourself to the RDC Analyst who is also new to their job.

Your brain freezes. The RDC analyst introduces himself and casually requests that you write the DA level profile data from the Census, along with the geography files—and the latest PCCF file—to a DVD. The computer account given him by MUN doesn’t seem to let him download files through IDLS or from your website.

Scenario #10 A graduate student has created static maps at the CT level using 2006 Census geospatial files for a research project. He wishes to post the resulting research paper, which includes data supporting his analysis and the CT level maps he created, on our university’s website. Is this allowed?

Scenario #11 We received a request from a researcher at The Canadian Institute for Research on Regional Development (CIRRD), located on the campus of the Université de Moncton. The institute's primary purpose is to serve as a centre for the study of regional development. Through its programs, it seeks to encourage continuing research into questions relating to regional development.

Scenario #11 It is an independent, nonprofit organization governed by a board of directors, which is its decision-making body. Its scope and research interests are wide-ranging, which should appeal to students of economics, government, public policy, political science, and sociology. The researcher would like to consult the products that are available by the DLI program (ex: Canadian Business Patterns). Could we give him access to this document?

Scenario #12 We have a joint project between CNIB and the Health Research Unit (HRU) of the Division of Community of Health in the Faculty of Medicine at Memorial University (MUN). A faculty member of the division is a member of the research team as are other permanent members of the HRU. As well, a special analyst has been hired to work on the project under the supervision of the faculty member. Any problems with access to DLI?

Scenario #13 I have just received a request from a recently retired faculty member who would like to have access to census PUMFs. I know that the license states that data is made available only to faculty “while they have such status” but he is considered a professor emeritus which, at our university, means he has full library privileges as well as university affiliation for the purposes of getting external research grants.

Scenario #13: The Special Ones! How is the DLI agreement to be interpreted in that case? He is receiving funding through the university’s grants office and will be performing academic research for publication in a journal.
