KEY DEFINITIONS PUBLIC PLACE: “Any building, structure, vessel, vehicle or conveyance or part thereof covered by a roof or not, to which the public has access…but does not include an outdoor patio, or a street, road or highway.”

KEY DEFINITIONS WORKPLACE: “A building, structure, vessel, vehicle or conveyance or part thereof, to which the public has access in which one or more employees work….but does not include an outdoor patio”

KEY DEFINITIONS SMOKING: “Includes the carrying of a lighted cigar, cigarette, pipe or any other lighted smoking equipment, but does not include smoke or smoking where smoke or smoking is used in a stage production of a theatrical performance”

KEY DEFINITIONS OUTDOOR PATIO “An outdoor area or partially enclosed outdoor area that is adjacent to an establishment where food or beverages are sold and where food or beverages or both are consumed by the public”

KEY DEFINITIONS EMPLOYEE: “A person being paid or unpaid… and includes volunteers and a person who is self- employed….”

EXEMPTIONS 1. PART OF A WORKPLACE THAT IS USED AS A PRIVATE RESIDENCE. 2. A WORKPLACE IN A DWELLING WHERE THE ONLY EMPLOYEES ARE PERSONS WHO LIVE IN THE WORKPLACE.

EXEMPTIONS 3. EXISTING DSRs UNDER THE TOBACCO CONTROL ACT. 4. HOTEL/MOTEL ROOMS THAT ARE DESIGNATED & SET ASIDE FOR SMOKING. THEY MUST BE RENTED FOR SLEEPING.

EXEMPTIONS 5. OUTDOOR PATIOS 6. SMOKING IN THEATRE PRODUCTIONS (PLAYS)
