3 Some people ask… Wouldn’t it be better to have a law cover the whole state rather than fewer laws scattered about Kentucky? Local is Leading the Way!

4 Local laws prompt local debate and educate citizens community by community. Enforcement is highly effective at the local level as a result of local debate and education. Local laws are more effective than a weak state law with preemption. Weak laws leave people unprotected. Many strong local laws make passing a statewide law more feasible. Kentucky is building support for a statewide smoke-free law, by passing local laws.

5 When enough local communities go smoke- free, we may be ready to pass a state law, but it must meet the following criteria: No preemption. The law must be comprehensive with few if any exemptions. Resources must be in place for enforcement. The more local communities that have laws, the less the state will have to spend on enforcement.

6 What are the Dealbreakers? Exemptions For: Restaurants Bars Race tracks/Casinos Bingo halls or other gaming facilities Private clubs with employees Private offices Cigar bars Smoking rooms Small businesses E-cigarettes

7 Common Unacceptable Exemptions Allow ventilation Allow tax incentives Allow licenses/permits Allow smoking after a certain time of day. Allow smoking in establishments where only people 18 years of age and older are allowed. Allow smoking inside and merely posts a warning sign on that outside of the establishment that smoking is permitted. Allow certain establishments to continue to allow smoking through a grandfather clause. Allow smoking to continue if employees consent to allow it.

8 Help us educate other Kentuckians Focus on the undebatable public health hazards of exposure to secondhand smoke Talk about success of local smoke-free action and the need for that to continue Emphasize that when we’re ready for a statewide law, it should be comprehensive – cover 100% of workplaces and still allow for stronger local action
