Using LDRs to Implement Ped/Bike Change

LDRs – Land Development Regulations The collection of laws and regulations that govern the use of land, zoning, building and alteration of every structure, and the linkage to the City’s Master Plan

LDR Section Standards for Site Plan and/or Plat Actions: Separation of different forms of transportation shall be encouraged mandatory. Includes pedestrians, bicyclists, and vehicles In lieu provisions to meet this performance standard

LDR Section Base District Development Standards Three types of special setbacks are established in order to provide for preservation of area for streetscape beautification, increased sidewalk width or bike lanes as established in the Adopted Bicycle and Pedestrian Masterplan, and/or expansion of roadways

Standard Improvements: The standard improvements which are to be accommodated in street right-of-way are: Travel lanes Parking lanes, where appropriate; Drainage devices Pedestrian ways Bicycle lanes or paths where appropriate, as required in the City’s approved Bicycle and Pedestrian Master Plan Any project unable to meet requirement shall have requirement to partake in in-lieu programs for an Alternative Human Powered Transportation Fund LDR Section (C) Streets (Rights-of-Way)

LDR Section Sidewalks Needs complete rethinking for more design flexibility, more defined pedestrian centric “promenades”, mixed use spaces Tie to City’s Bicycle and Pedestrian Master Plan and clearly defined by a “street type” If project is unable to meet criteria, shall participate in in-lieu program for Alternative Human Power Transportation Fund Alleys Pocket parks Shared paths Problem with deferred sidewalks…. 10 foot sidewalks in CBD 6 foot minimum elsewhere Strict criteria for sidewalk deferrals

When a development is located between improved portions of a bicycle trail system specified in Bike Ped Master Plan, provisions shall be made for the completion of any unimproved linkage. Need not abut or be adjacent to the property proposed for development. Applies to LDR Section Bicycle Trails, Paths, and Lanes Off road paths between developments Along canals Through parks, open space, public buildings Alongside schools Other designated areas

LDR (C) 1 c Bicycle Parking Bicycle parking facilities shall be provided in a designated area per “bicycle space” defined as a 3’ x 5’ area (15 sq ft) with a stationary bike rack that allows the bicycle to be secured. Spaces must be close to the building entrance that they are intended to serve. Non residential/commercial Multi family residential Community / govt buildings

LDR SECTION (I) (1) (g) Low Density Residential (RL) District Performance Standards Performance standard regarding bike-pedestrian networks and interconnection specifically applies to low and medium density developments. It should also apply to higher density residential developments or commercial developments seeking higher density.

LDR SECTION (E) (3) (c) In-Lieu Fees New development, use conversion, additions and/or renovations may request up to 30% of parking spaces to be replaced by a payment in-lieu of the parking program. Applies to residential and mixed use developments as well as commercial In-lieu fee to be valid for the entire City of Delray Beach In-lieu fees to be split between parking and a separate fund for Alternative Human Powered Transportation (bike and ped).
