CA Dream Act Overview Allows non-resident students to pay in-state fees AB 540 – 2001 Private Scholarships can be administered by public institutions AB 130 – July 2011 State funded grants including Cal Grants and institutional grants AB 131 – October CASFAA Annual Conference December 8 – 11, 2012 Anaheim, CACASFAA Annual Conference

Assembly Bill (AB) 540 (Firebaugh, 2001) Created the first state authorized benefit for undocumented students in California – exemption from non-resident tuition at public postsecondary institutions Criteria: Attended a CA high school for 3+ years Graduated from a CA high school or the equivalent Enrolls in a public CA college or university If the student is without lawful immigration status, student must file an affidavit with the institution stating that he/she has filed an application to legalize status or will file as soon as eligible CASFAA Annual Conference December 8 – 11, 2012 Anaheim, CACASFAA Annual Conference

AB 540 Students may be: Students who are undocumented Students who are U.S. citizens, but who are not CA residents Usually dependent students living in the state whose parents are not CA residents Sometimes former CA residents In any case, the students must meet the AB 540 criteria on the previous slide CASFAA Annual Conference December 8 – 11, 2012 Anaheim, CACASFAA Annual Conference

AB 540 Students are not: Non-immigrants, as defined by federal immigration law, may hold one of the following visas: A, B, C, D, E, F, G, H, I, J, K, L, M, N, O, P, Q, R, S, TN, TD, V, TROV and NATO. Students with a Non-immigrant Visa status other than T or U*. a home school does not meet the definition of a "high school in California" as it applies to this exemption eligibility. Students "home- schooled" by a parent who does not hold a CA teacher credential 6 *T and U visa holders are eligible under AB CASFAA Annual Conference December 8 – 11, 2012 Anaheim, CACASFAA Annual Conference

AB 540 Students are not: Students living out-of-state and enrolling in a private California "internet high school" Course work completed via a distance learning or a correspondence program, does not meet the definition of a "high school in California" as it applies to AB 540 and CASFAA Annual Conference December 8 – 11, 2012 Anaheim, CACASFAA Annual Conference

8 Retention of the Affidavit Public campuses are doing this already Non-public campuses must retain the AB 540 eligible student’s affidavit. Completion of the affidavit for “T” and “U” visa holders is not required CASFAA Annual Conference December 8 – 11, 2012 Anaheim, CACASFAA Annual Conference

3.“Valid For Work Only With DHS Authorization.” Issued to people lawfully admitted to the United States on a temporary basis who have DHS authorization to work. Dream Act Aid is not Deferred Action (DACA) CA Dream Act aid is not the same as Deferred Action for Childhood Arrivals (DACA) relief DACA does not confer a new status for students. Does not affect AB 540 status, the criteria used for Dream Act Aid. Deferred Action Requirements 1. Entry into the U.S. before the age of 16; 2. Five years of continuous residence and actual physical presence in the U.S. since June 15, 2007, and on June 15, 2012; 3. Enrollment in or graduation from high school or other qualifying educational program or obtained GED certificate; 12

4. No convictions for felonies, significant misdemeanors, multiple misdemeanors, and no national security or public safety threats; and 5. At least 15 years of age at the time of application, but not more than 30 years of age on June 15, Additionally, these individuals are required to pay a $465 filing fee to DHS. 13 Deferred Action Requirements

AB Private Scholarships 15 In effect since January AB 540 students can apply for & receive private scholarships administered by public schools: Scholarships funded through private donors alumni contributions individual departmental efforts Direct students to look for online scholarship application and timelines at campus websites.
