Housing Department Staff Recommendation Approve key terms of 2 nd Amendment to Development, Loan & Lease Agreement with Heritage Square Housing Partners, LP  CEQA exemption for Historical Resource projects  Amend scope to include Decker House relocation as developer’s responsibility  Relocate Decker House to Heritage Square South  Amend FY 2015 dept. operating budget and approve appropriation of $225K from Inclusionary Fund balance for Heritage Square project 2

Housing Department Staff Recommendation  Appropriation will increase City loan to developer by $225K to fund cost of Decker House relocation  Costs include development of plans, Historic Preservation process for approval of Certificate of Appropriateness, lead-based paint testing and abatement, two moves, cribbing for temporary relocation, grading, permanent concrete foundation, permit fees, contingency, prevailing wage  Developer will do advertised bids for the relocation and outreach to subcontractor workshop attendees 3

Housing Department Northwest Commission Northwest Commission action on 1/22/15  Recommended City Council approval of staff recommendation, but with a provision that contracts between City and developer include a “24-hour construction clause.”  City law does not allow 24-hour construction: activity limited to 7 a.m. – 7 p.m. Mon-Fri and 8 a.m. – 5 p.m. Sat (PMC, Section )  Construction contract between developer and Dreyfuss already provides for additional work shifts or overtime if necessary to expedite the project.  Staff did not incorporate a “24-hour construction clause” in the recommendation to City Council 4
