PINE CREST CENTRE PROMOTIONAL COURT RULES AND REGULATIONS 1.No verbal requests will be considered and no promotional bookings will be confirmed, until a written request has been received together with a signed indemnity form and proof of payment, at least 7 (Seven) days prior to the promotion. 2.Proof of payment is to be faxed or ed to Bookings will not be confirmed until proof of payment is received at the centre. 3.The reference on your invoice is to be quoted on the deposit slip. 4.No bookings/ provisional bookings will be done without full contact details – this includes a landline and a fax or address, and a written plan of what will go into this area including the dimensions of each item in the display, electrical requirements etc 5.Payments are to be made via direct deposit only. Banking details are included. Under no circumstances will cash be accepted on site. 6.There is a minimum booking period of 3 (three) consecutive days for any promotional court. A promoter may utilize the court for fewer days but the full three days must be paid for. NO exceptions will be made. Centre management reserves the right to set maximum limits on booking periods at its own discretion. 7.There will be no refunds or credits of any kind so it is up to the promoter to ensure their bookings and payments are correct. 8.The centre must be given 7 (seven) days written notice regarding rescheduling of dates in order not to lose any payments made. The centre will not be held responsible should the promoter’s preferred dates for rescheduling not be available. 9.Centre promotions enjoy a preference, and should it be required, other promotions will be rescheduled. 10.Centre tenants are offered a discount on promotional court prices, but otherwise all other promotional court rules apply to tenants who are promoting within the promotional areas. 11.Whilst the centre will ensure that no similar promoters are scheduled for the same days, the centre reserve the right to select whichever promotions they deem will benefit the centre. 12.Once bookings have been made they will not be altered in any way to accommodate tenants. 13.Centre Management reserves the right to terminate any promotion or to change/ remove any promotional material from the display at its own discretion. No handwritten signage is allowed. 14.NO EXCHANGING OF MONEY MAY TAKE PLACE FROM THE PROMOTIONAL COURTS. This will result in immediate cancellation without refund of the rest of the promotion. 15.NO HANDING OUT OF FLIERS IN THE PROMOTIONAL COURTS OR OTHER CENTRE AREAS IS ALLOWED. 16.Promoters may not extend their promotion in any way outside of the promotional court, which would include staff walking into the mall areas and approaching shoppers. Should shoppers be approached or harassed in any way the promotion will be cancelled immediately with no refund. Walkways especially around the escalators need to be kept clear. 17.In promotional areas where there is no clear division of promotional courts the promoter is to use their discretion with the following in mind: 18.There must be at least 3 (three) meters from any shop front, no entrance to a store must in any way be obscured and the promotion must not be set up in any way that would inconvenience shoppers trying to move around the centre. 19.Promoters must be professional, well dressed and groomed, courteous and well spoken. No smoking, eating, drinking or chewing gum is allowed in the promotional areas. 20.The centre does not supply tables, chairs or stanchions for cordoning off, under any circumstances to promoters. 21.The centre will not be responsible for tables and chairs left in the mall area after hours. 22.All promoters are responsible for any parking costs incurred for the duration of the promotion. The centre management, Landlord or managing agent will not be held liable for any costs incurred. 23.Promotional courts are to be set up before 08:30 each day so they are ready for promotion by 09:00. Promoters who are not ready by 09:00 will not be allowed to promote, nor refunded. Promoters need to promote until 17:00 with the exception of Sunday, which is 16:00. Promoters who remove material earlier will not be allowed to continue their promotions, nor will they be refunded. 23.Promoters may not remove large or bulky displays, or cars before 18:30 in the evenings. In the case of vehicles they may be removed before 07:00 the following morning, should they be later they will be charged for another day. 24.No more than 3 (three) vehicles will be allowed into the Pick n Pay promotional court at a time. No more then 4 promoters are allowed in your exhibition area. 25.Should any damage to persons, the centre, or tenants property occur as a result of the promoters or promotions during promoting times or items being brought in or removed from the centre, the promoter will be held liable for the cost of repair. 26.Promoters will not be allowed to keep trolleys, boxes, waste material or any packaging in the promotional courts. No promotional items can be stored overnight at the management office, security, under the escalators or the back passages. 27.NO music / DJ's or comperes will be allowed in the promotional courts for any promotions 28.All promotions are subject to spot checks to ensure that the original proposal submitted has been adhered to. 29.The centre’s fittings, furnishings, fixtures or related items ie pot plants, lamp posts, walls, shop fronts, pillars etc may not be used by promoters as display structures or support. 30.NO posters, stands or props of any kind over 1.5m will be allowed in any of the promotional areas except the escalators. These should be positioned in a way so as not to obscure or interfere with tenant’s stores in any way. 31.The promoter is responsible to ensure that all installations eg electrical, plumbing and fittings, and any other related item comply with the Occupational Health and Safety Act, failure to do will result in cancellation of the promotion without refund. Electrical cords must be taped to the floor and removed in a way so as to avoid damage to centre property. Should any situation be left in the promotional courts that require cleaning or repair of any kind, the cost will be for the promoters account. 32.It is the promoter’s responsibility to ensure that the display adheres to all fire regulations. Pine Crest centre will in no way take responsibility for any repercussions of non- compliance. 33.Whilst the centre does have general full time security, the centre will not be held responsible for the promotion or any of the items in the display.
