Federal Demonstration Partnership FDP Agencies FDP General Terms and Conditions Agency Implementation of FDP Terms and Conditions. FDP Prior Approval Matrix Agency Specific Requirements (exceptions to FPD terms and conditions).

FDP Terms and Conditions Incorporates administrative and financial requirements of OMB Circulars as they apply to awards made by Federal agencies to educational organizations, when each is a party to FDP. Streamlines OMB Circular A-110. Award notices will designate applicability of FDP Terms and Conditions (T&C).

Implementation of FDP Terms and Conditions National Science Foundation (NSF) –All new grants and funding increments on existing grants (10/1/2002). –Applies to all NSF grant awards. –Does not apply to cooperative agreements or fellowship awards.

Implementation of FDP Terms and Conditions National Institutes of Health (NIH) –Awards will include a footnote indicating FDP Phase IV. –Applies to all NIH grant awards. –Assuming that they don’t apply to NIH cooperative agreements or contracts. –Does not apply to other DHHS units (HRSA, CDC, FDA…).

Implementation of FDP Terms and Conditions National Aeronautics & Space Administration (NASA) –NASA will implement FDP-type awards starting 10/1/02. –Applies to research grants. –Does not apply to cooperative agreements, contracts or other transactions.

FDP Prior Approval Matrix Summarizes prior approval and other requirements of FDP General Terms and Conditions. Some items are uniform for all agencies. Denotes the exceptions and/or exclusions made by individual agencies.

Cost Sharing FDP: Recipient may include unrecovered indirect costs as part of cost sharing or matching. Other Awards: Unrecovered indirect costs may be included as part of cost sharing or matching with the prior approval of federal awarding agency.

Program Income Additive method will be used to dispose of program income, unless the agency- specific requirements of the award specify otherwise. Awarding agency could specify one of three methods to treat program income (additive, deductive or combination).

Rebudgeting Prior Approval is Not Required Rebudgeting among budget categories. Rebudgeting between direct and f&A costs. Rebudgeting of funds allotted for training allowances to to other categories (except NSF).

Pre-award Costs Prior approval waived for pre-award costs incurred 90 days prior to award. Prior approval required for pre- award costs incurred more than 90 day before award.

Foreign Travel Prior approval is waived for foreign travel expenses, except for ARO (Army Research Office) awards.

Equipment Own equipment upon acquisition without conditions or without obligations to the sponsor at termination of project. Equipment is considered “exempt property”. Trade in equipment purchased with project funds to buy replacement equipment.

Agency Specific Requirements Each agency has specific requirement to FDP General Terms and Conditions. Specific Requirement documents are located on the FDP/NSF website, _fdp.htm.

FDP on SPA Web The SPA website will contain the following FDP data: General Terms and Conditions Agency Implementation Schedule Prior Approval Matrix Agency Specific Requirements for NIH, NSF and NASA. List of the University’s FDP contacts.

OMB Circular A-21

Proposed Changes to A-21 Attempt to streamline A-21, A-122 and A-87. Issued by OMB 8/12/02 and comments due in 60 days (10/11/02). Document lists all three circulars and has “Proposed Change” field.

Prior Approval Requirements Continues existing, adds new or reintroduces prior approval for: –Foreign Travel (each trip) –Special Purpose Equipment –Publication and Printing –Pre-award Costs –Overtime Premiums –Rearrangement and Alteration Costs

WU Response Prior approvals are: –A big step backwards. –FDP and expanded authorities proved that prior approvals added little value. –Will redirect PI time from research to admin. –Will create additional administrative burden for grantee, sub-grantee and federal agencies.

Responses to OMB WU submitted ten page response from VC of Research and VC of Finance. Request OMB to withdraw proposed changes and start new effort which includes participation of universities (concurring with COGR response). OMB has received about 250 responses to date. mailbox was completely full.
