What are the basic analytical questions one must ask on this גמרא? Please note: As you move forward indicate if you feel this is a basic \ fundamental issue or an issue that requires analysis but it can be viewed as a secondary issue. Highlight any מחלוקת. They usually require analysis. Sometimes (as we have seen in the past), the most basic question in a סוגיא may not emerge from an explanation of a מחלוקת, but it may float to the surface based on a basic assumption that is being made by each מאן דאמר. What is the הסבר of the מחלוקת between ר"א & ת"ק ? ת"ק- רק המלך הקדוש ר"א – אפילו הא-ל הקדוש What is the הסבר of מחלוקת between תוס' & ר"ח as it relates to the four inserts inש"ע ? תוס' – חוזרין ר"ח – אינו חוזר Rabbi Shalom Richter

What do ר"אand ת"ק disagree on? Let’s take another look. What is the הסבר of מחלוקת between תוס' and the תר"י as it relates to the issue of the מחלוקת between ר"א and ת"ק . תוס' - ר"א and ת"ק argue בדיעבד תר"י - ר"א and ת"ק argue לכתחלה Rabbi Shalom Richter

The most basic question: Let’s look at the proof text for ר"א : וַיִּגְבַּהּ ה' צְבָאוֹת בַּמִּשְׁפָּט וְהָאֵל הַקָּדוֹשׁ נִקְדָּשׁ בִּצְדָקָה: Consider the opinion of the ת"ק as taken from our תפלה during the ימים נוראים: וַיִּגְבַּהּ ה' צְבָאוֹת בַּמִּשְׁפָּט וְהָאֵל הַקָּדוֹשׁ נִקְדָּשׁ בִּצְדָקָה ברוך אתה ה' המלך הקדוש This פסוק is the proof text for the ת"ק as well!!! Rule: While offering a סברא for one opinion, often the ראשון will include the סברא of the other dissenting opinion in his comments. מאירי – שהרי חלק ר"א ואמר אפ' אמר הא-ל הקדוש יצא דכתיב ויגבה ה' צבאות במשפט והאל הקדוש נקדש בצדקה אלמא אף בעת המשפט קראו הא-ל הקדוש Rabbi Shalom Richter

The definition of הא-ל = Almighty One of the expressions of הא-ל is משפט According to the ת"ק the way that בני ישראל defines its relationship with ה' during this time of year must be limited to the concept of משפט Rabbi Shalom Richter

What is the view of ר"א? ר"א maintains that the relationship is not limited to משפט but rather accentuated with משפט מאירי – שהרי חלק ר"א ואמר אפ' אמר הא-ל הקדוש יצא דכתיב ויגבה ה' צבאות במשפט והאל הקדוש נקדש בצדקה אלמא אף בעת המשפט קראו הא-ל הקדוש Rabbi Shalom Richter

Is one חוזר or not? When חז"ל made this תקנה of saying המלך how did they express it? חוזר - תוס' Integrated into the essence (fabric) of תפלה תר"י – אינו חוזר תפלה Addendum Rabbi Shalom Richter

Both of these position assume that we are חוזר for המלך… How were the inserts formulated? תר"י – אינו חוזר משפט as it relates to מלכות תוס' - חוזר Any issue related to משפט is integrated in the fabric of ש"ע Rabbi Shalom Richter
