Purchasing Louisiana In the early 1760s, the French had given Louisiana to Spain and Britain and left North America. Going back to the Pinckney Treaty with Spain, the US had access to New Orleans, which was very important for farmers. In 1801, the Spanish signed a secret treaty with France to return Louisiana to them. In 1802, US access to New Orleans was blocked. When Jefferson looked for a way to purchase the city of New Orleans, France offered Louisiana

This presents a problem for Jefferson, a strict constructionist—the Constitution does not allow the President to purchase land. Solution—Set it up as a treaty and have the Senate ratify it.
