Amendment to OIP Program and Fiscal Year 2019 General Fee Schedule City Council Meeting January 28, 2019

Amendment to Inspection Ordinance Background Inspection Ordinance (i.e. Occupancy Inspection Program) was adopted in 1973 and last revised in 1991 On May 7, 2018, the City Council considered the following four alternatives: Streamline OIP to refocus on life and safety violations Discontinue OIP, in lieu require seller to obtain and disclose a property records report Discontinue OIP Retain OIP without changes City Council directed staff to explore an additional alternative that would remove required City inspections, while still addressing life and safety violations

Amendment to Inspection Ordinance Background On August 27, 2018, the City Council reviewed staff’s recommendation for a Presale Self-Certification Program and directed staff to amend the respective ordinance revising the OIP Objectives of the Presale Self-Certification Program: Continue requiring abatement of life and safety code violations Eliminate (or significantly reduce) delays in the sale/transfer of properties Eliminate redundancies and inefficiencies Components of the Presale Self-Certification Program: Presale Certificate of Completion Presale Certificate of Inspection

Amendment to Inspection Ordinance Background Presale Certificate of Completion No City inspection is required Over the counter or online processing New proposed fee of $26.97 Presale Certificate of Completion - eligibility requirements: Properties with major life and safety code violations are not eligible Properties with open code compliance cases are not eligible Properties whereby the actual square footage of the living area is 10% or greater than the square footage recorded with the Los Angeles County Tax Assessor are not eligible

Amendment to Inspection Ordinance Recommendations Find that the proposed action is exempt from the California Environmental Quality Act (“CEQA”) in accordance with Section 15061(b)(3), the General Rule that CEQA only applies to projects that may have an effect on the environment and; Adopt a resolution amending the Fiscal Year (FY) 2019 General Fee Schedule as detailed in the “Proposed Fee Schedule Amendment” section of this report.
