Impact Fee Ordinance Section 23-93(a) Post-May 20, 2013 “Such an alternative impact fee calculation shall be submitted prior to the issuance of any building permit and must be approved by the BCC prior to issuance of any certificate of occupancy, temporary or permanent.” Pre-May 20, 2013 “Such an alternative impact fee calculation shall be submitted as follows: (1)Prior to the issuance of the initial certificate of occupancy for a non- phased project; or (2)Prior to the issuance of the initial certificate of occupancy for a phase within a phased project.”

3. Impact Fee Ordinance Section 23-93(c)(2) Post-May 20, 2013 “The independent source is a local study carried out pursuant to an accepted methodology and which studies the four (4) variables of ADT, %NT, ATL, and LADF.” Pre-May 20, 2013 “The independent source is a local study carried out pursuant to an accepted methodology of transportation planning or engineering.” (Could study any one or more of variables)

4. Ordinance Under ordinance’s fee schedule, transportation impact fees for schools are based on square footage. Basing impact fees on student enrollment / staffing would conflict with Tindale-Oliver study that was basis of 2013 ordinance update, and require amendment to ordinance.

5. Ordinance Ordinance amendment would be required to change timing of alternative study. Ordinance amendment would need to be retroactive for this project to benefit, and Ordinance amendment would mean any developer who obtained a permit from 5/20/13 to present could potentially request a refund of fees.
