Contractor stand-down Western Region 2018 Safety starts with me. Contractor Stand Down 6th September 2018

Introduction It is crucial that all parties understand their Roles and Responsibilities with regards to safety and that it is not only a legal requirement, but also a business necessity. The focus is to minimise exposure to risk goal and to continuously have hazard and risk assessments with the aim of eradicating/ reducing incidents and or accidents.

SHE Requirements in terms of construction regulations(GNR SHE Requirements in terms of construction regulations(GNR.84 OF 7 February 2014) SHE Requirements construction reg 5(1b-s) Duties of the client(Openserve/Telkom) SHE specification provided to the by the client to the SP, which is then used to develop a SHE plan. The SHE specification to be included in the tender documents Potential principal contractors submitting tenders ensure adequate provision for the cost of health and safety measures, Client- Ensure the principal contractor to be appointed has the necessary competencies and resources to carry out work safely. Ensure before any work commences on a site that every principal contractor is registered and in good standing with the compensation commissioner. Appoint every principal contractor in writing for the project or part thereof on the construction site, Discuss with the principal contractor the requirements of the principal contractors SHE plan and thereafter finally approve that plan for implementation. Ensure that the copy of the plan is available on request to employee, contractor and or inspector

Continued Ensure that periodic health and safety audits and document verification are conducted at intervals mutually agreed upon , but alt least once every 30 days. Ensure a copy of the health and safety audit report is provided to the principal contractor within 7 days after the audit; Stop any contractor from executing a construction activity which poses a threat to the health and safety of persons which is not in accordance with the clients' health and safety specification and the principal contractors health and safety plan for the site. Where changes are brought about to the design or construction work, make sufficient health and safety information and appropriate resources available to the principal contractor to execute the work safely; And ensure that the health and safety file contemplated in reg 7(1) b) is kept and maintained by the principal contractor.

Duties of principal contractor and contractor (SP’s and sub-contractors) Provide to the client a suitable, sufficiently documented and coherent site specific health and safety plan. Notification of construction work to dept. of Labour(done within 7 days before commencement of work) Open and keep on site a health and safety file, and must be available on request to the inspector, client, the clients' agent or contractor. On appointing any other contractor: (sub-contractors) -Provide contractors tendering to perform construction work for the principal contractor with relevant sections of the health and safety specification pertaining to the work to be performed. - Ensure that potential contractors tendering have made sufficient provision for health and safety measures during the construction process. Ensure no contractor is appointed to perform construction work unless the principal contractor is reasonable satisfied that the contractor he intends to appoint has the necessary competencies and resources to perform the work safely.

Continued Ensure prior to work commencing onsite that every contractor is registered and in good standing with the compensation Fund or licensed compensation insurer. Appoint each contractor in writing for the part of the project on the construction site. Take reasonable steps to ensure that the health and safety plan is implemented and maintained on the construction site; Ensure that the periodic site audits and document verification are conducted at intervals as agreed between the principal contractor and any other contractor, but at least once every 30 days; Stop any contractor from executing work not in accordance with the client specification and principal contractor’s health and safety plan for the site. Hand over a consolidated health and safety file to the client upon completion of construction work, including records of drawings, design. Include a list of all contractors onsite accountable to the principal contractor. Ensure that all his employees have a valid medical certificate of fitness specific to the construction work to be performed and issued by occupational health practitioner(form of annexture 3).

What does the 37.2 agreement mean? 1. Warranty of compliance In terms of this agreement the Mandatory warrants that he agrees to the arrangements and procedures, as prescribed by the Client, and as provided for in terms of Section 37(2) of the Occupational Health and Safety Act 85 of 1993 and Regulations (“the OH Act”), for the purposes of compliance with the OHS-Act. The Mandatory acknowledges that this agreement constitutes an agreement in terms of Section 37(2) of the OHS-Act, whereby all responsibility for health and safety matters relating to the work the Mandatory and his/her employees are to perform on the premises in terms of the scope of work shall be the obligation of the Mandatory, including ensuring the health and safety of visitor and other parties. 2. Mandatory an employer The Mandatory shall be deemed to be an employer in his/her own right whilst performing work in terms of the scope of work on behalf of the Client. In terms of Section 16 (1) of the OHS-Act, the Mandatory shall accordingly ensure that himself and/or his/her nominated Chief Executive Officer comply with the requirements of the OHS-Act.

Incident Management Client’s responsibility (Openserve/Telkom) Where a fatality or permanent disability injury occurs on a construction site, the client must ensure that the contractor provides the provincial director with a report contemplated in section 24 of the act; in accordance with regulation 8 and 9 of the GAR, 2013; and that report includes the measures that the contractor intends to implement to ensure safe construction site. Contractor’ responsibility : (Service providers/subcontractors) The Contractor shall implement and manage a Workplace incident book; which will include all reportable incidents, near misses and first aid treatment. The Contractor shall within 7days report all incidents referred to in Section 24 of the OHS Act to the Department of Labour as well as to the Client within 24hrs of occurrence . in accordance with regulation 8 and 9 of the GAR, 2013;shall report and investigate all section 24 incidents A copy of the submitted documentation to the Department of Labour as per specified statutory requirement timelines shall be forwarded to the Client after submission to the Department of Labour. Any other relevant authority must be informed of the incident by the Contractor e.g. Compensation for Injuries and Diseases Commissioner and South African Police Services as and when required.

continued Contractor responsibilities The Client shall be informed of any investigation or formal inquiry to be conducted in terms of section 31 and 32 of the OHS Act, involving any incident arising from any activities undertaken and controlled by the Contractor. As per section 30 of the OHS Act, the Client reserves the right to be informed of any notices issued by the Department of Labour.
