SB 1873 Physical Fitness - Background SB 1873, passed during the 85th legislative session (2017), amends TEC 38.0141 to require the following: The Commissioner must complete a report on physical education (PE) provided by each school district; The report results must be published on the Texas Education Agency’s website. TEC 38.041 requires each LEA to provide information on health and safety of student populations.

The published report must include the following information: Physical Education Report The published report must include the following information: Number of PE classes offered at each campus in the district. Number of days, classes, minutes offered each week by each campus Four weeks in leading to snapshot in October.

Physical Education Report The published report must include the following information: Ratio of students enrolled in PE classes in the district compared to the overall enrollment; Average PE class size at each campus in the district;

Physical Education Report Number of PE teachers in the district who are licensed, certified, or endorsed by an accredited teacher preparation program to teach PE;

Physical Education Report Whether each campus in the district has the appropriate equipment and adequate facilities for students to engage in the amount and intensity of physical activity required under Section 28.002.

Business Rule 30090-0115 A new rule was created to warn users about reporting more than five number of days taught in a week. School on days other than Monday through Friday is rare. Domain of Values is 0-7 therefore, created as Special Warning in order to capture what happened.

Business Rule 30090-0115 If NUMBER-DAYS-TAUGHT-WEEK-1, NUMBER-DAYS-TAUGHT-WEEK-2, NUMBER-DAYS-TAUGHT-WEEK-3, or NUMBER-DAYS-TAUGHT-WEEK-4 is not blank, then NUMBER-DAYS-TAUGHT-WEEK-1, NUMBER-DAYS-TAUGHT-WEEK-2, NUMBER-DAYS-TAUGHT-WEEK-3, and NUMBER-DAYS-TAUGHT-WEEK-4 should be 1-5. Physical Fitness Q & A Question: If multiple teachers are assigned to a particular PE course section, which PE teacher is reported with the elements? Answer: Only the Teacher of Record is reported with the Number of Students in Class (E0170) field greater than zero for each academic staff responsibility, and only the Teacher of Record is reported with the eight new data elements. SB 490 Counselors- Background SB 490, which was passed during the 85th Legislative session (2017), amends TEC 42.006 (a-2) to require the reporting of information regarding the availability of school counselors (ROLE-ID 008) at each campus. What is the purpose of this SB? In the statute to calculate the availability of counselors to serve students needs. Legislators are trying to improve the ratio of teachers to counselors in public schools.

SB 490 TSDS PEIMS Data Changes The reporting of E1057 MONTHLY-MINUTES will be applicable for counselors (ROLE-ID 008) in the 2018-2019 school year on the StaffResponsibilitiesExtension complex type to accomplish the requirement of SB 490. Business validations have been updated to allow counselors to be reported with the MONTHLY-MINUTES data element (E1057). Monthly Minutes will be applicable to counselors now. Business Validations have been added to enforce the new requirement Source: PEIMS Requirements Staff 90 record 8.2.3 pg. 19 MONTHLY-MINUTES is also reported for only one non-instructional ROLE-ID “008” Counselor, and is based upon 9600 minutes a month (8 hours per day x 5 days per week x 4 weeks per month). The total MONTHLY-MINUTES are reported for each unique service that is provided. The four weeks preceding the PEIMS Fall snapshot (as-of) date (the last Friday in October) must be considered to calculate the monthly minutes. For example, a class that is taught for one hour every day would report 1,200 monthly minutes (60 minutes x 5 days x 4 weeks) for that class. A class taught one hour three times each week would report 720 monthly minutes (60 minutes x 3 days x 4 weeks). A class taught for different amounts of time each week would be reported with a cumulative monthly minute total.

SB 490 Monthly-Minute Examples Scenario #1: Full-Time Staff Person – Counselor (100%) ROLE-ID MONTHLY-MINUTES 008-Counselors 9600 Scenario #2: Half-Time Staff Person – Counselor (50%) ROLE-ID MONTHLY-MINUTES 008-Counselors 4800 Teachers are calculated at 8400 FTE for teacher and 9600 FTE for counselor Example #3: 6300 and 2400 minutes do not add up to 9600 and do not need to since teachers earn a full FTE with 8400 monthly minutes. Scenario #3: Full-Time Staff Person – Teacher (75%) and Counselor (25%) ROLE-ID MONTHLY-MINUTES 087-Teacher 6300 008-Counselor 2400

Business Meaning: All of the responsibilities for a staff person should have total TX-MonthlyMinutes of at least 60 minutes. Reason for revision: Removed “instructional” from the business meaning in order to include counselors (Role ID 008) to report MONTHLY-MINUTES (E1057). Explanation: Business Meaning in previous year read “All of the instructional responsibilities for a staff person should have total TX-MonthlyMinutes of at least 60 minutes.”
