Genesis of Proposed Agreement July 24, 2013 Board of Public Works (BPW) Meeting KHov request on BPW agenda for Wetlands Permit to: Install 179 feet of 14 sewer force main beneath Cox Creek via horizontally directionally drilling Construct 10-slip community pier on Chester River Total Wetland Impacts: Zero permanent impacts 822sf temporary impacts 2

Genesis of Proposed Agreement BPW Postponed Vote on Wetlands Permit Pending KHov and the County enter into an agreement to address the following 3 items: 1) Permanent Easement on 131 acre Ecological Park (Tanner Property) 2) Environmental Site Design (ESD) for project stormwater management 3) Proposed reduced project density of 1079 units is contractually met 3

Status of Proposed Agreement The agreement received by the County from KHov has been posted on the County Web page for public review. Commissioners are looking for public input prior to responding/negotiating the proposed agreement 4

Key Aspects of Proposed Agreement BPWs Issue 1 – Eco-Park on Tanner Property Proposed Agreement provides for the 131 acre property to be deeded to the County Proposed Eco-Park plan calls for +/- 30 acres for active recreation (multi-purpose ball fields), +/- 100 acres for conservation County working with State to determine easement structure to ensure land stays in conservation. Governors Office is supportive of proposed plan including active recreation component. 5

Key Aspects of Proposed Agreement BPWs Issue I – Eco-Park on Tanner Property Per the proposed agreement the property dedication would: Fulfill the DRRA off-site park dedication (27 acres) Preclude the DRRA requirement to purchase sewer allocation of 271 units eliminated from Tanner Fulfill the DRRA infrastructure requirements of: 1500gpm water well* Upgrade of CBBP water treatment plant* Installation of 11,068 lf of 12 water main* *Previously completed with County funds 6

Key Aspects of Proposed Agreement BPWs Issue 2 – Environmental Site Design (ESD) for Project Stormwater Management Per the DRRA, the Project has an administrative waiver from the current Stormwater Management Regulation Proposed Agreement, KHov would use its best efforts to implement ESD practices 7
