HOW TO DO BUSINESS WITH THE FEDERAL GOVERNMENT

Company Goals & Objectives Once the decision has been made by management within a company to pursue contracting opportunities the Federal Government has to offer, success is contingent upon complying with the procurement regulations and laws.

Procurement Regulations The following regulations apply to the majority of Federal Government contracts and subcontracts: Federal Acquisition Regulations (FAR) Federal Acquisition Regulations Agency Supplements (Army, Navy, Air Force, DHS, etc.)

Procurement Regulations – Federal Acquisition Regulations & Agency Supplements The regulations establish uniform policies and procedures for the acquisition of goods and services by all executive agencies (DoD, DOE, DHS, USDA, etc.) They establish the “Rules of Engagement” that agencies are to follow for soliciting proposals from companies and the administration of contracts.

Procurement Laws Some of the more common laws that must not be violated prior to contract award, during contract performance, and after the contract ends are: Truth in Negotiations Act (TINA) Cost Accounting Standards (if applicable) False Claims Act False Statements Act Fraudulent Activities (bid rigging, bid rotation, collusive bidding, price fixing, etc.)

Operating Systems The following day-to-day operating systems must be compliant for doing government contracting work: Accounting (includes billing) Estimating Budget & Planning Purchasing Material Management

What Does It Take To Comply? A knowledgeable and experienced human resource infrastructure is required in Federal Government contracting in the following disciplines: Senior Management (President, VP, GM, etc.) Legal Marketing Contracts Subcontracts Security Operating Systems (Slide 6) Compliance Pricing
