Section 1 Definition & kinds of right
A group of obligatory rules that organizes the relationship between individuals in a certain society. Thus, the law decides:- what is the legal interest of a person? What is the authority of the owner of right? What are the limits of that authority? The law also prohibits all members of society from invading those authorities.
When the legislator gives privilege to a person It imposes the duty of respecting these privileges on all other individuals
Is a legal interest decided by law to a definite person Public duty (not to invade) arises to face each right
The idea of legal property leaned to law whereas the property transfers from one person to another must be legal. NOT LEGAL
Relative right Rights which arise from a specific agreement or mutual obligations. Absolute right A right that creates public duty (all other people have a duty to protect those rights.
Private Duty In which a person is obliged to do something (active) or refrain Passive) from doing something for the benefit or interest of another party. Public Duty All persons in the society have a general duty not to act negligently and harm others around them. Passive Test No physical burden Limited to the obligee
