Copyright 100 When the work is captured in a “fixed format” it is copyrighted. A work does not have to published in order to be copyrighted. Game Board

Copyright 200 No! All published work in assumed to be copyrighted by its creator Game Board

Fair Use 100 Fair Use allows for the use of the copyrighted work for all of these situations: commentary, parody, news reporting, scholarly research, for-profit use, and education.

Fair Use 400 Does everything we copy and use in education fall under the Fair Use guidelines and therefore is not copyrighted for educational purposes?

Fair Use 400 No. In fact, showing entertainment movies outside of the home or classroom is considered public performance, and it not covered by Fair Use. Showing movies for entertainment during the school day can be a violation of copyright. Schools need to secure a Public Performance License from Moving Licensing USA. Web Distribution 100 As long as it is for an education use, I can distribute copyrighted materials on the Web because they are covered by Fair Use?

Web Distribution 100 No. Fair Use does not give anyone but the creator of the work permission to distribute it. Game Board

Web Distribution 200 If I am making a video for my class using Animoto, I can upload any music I own or find on the Web to my video?

Web Distribution 200 No. You can only use music you have created yourself, copyright-free music, and music for which you have paid the creator for the rights to use it. Game Board

Web Distribution 400 If my wiki is protected by a password and only people I invite can view the work, students, teachers, and I can use anything we want for educational purposes (covered by Fair Use)?

Web Distribution 400 The intellectual property of others that resides on a private wiki is covered by Fair Use, as long as it meets the other criteria for Fair Use. If the work is used in a public forum, such as Animoto, Slideshare, PhotoPeach, Facebook, and more, this would violate copyright. Game Board
