1 Copyright Laws Copyright Protection and Fair Use

2 What is Copyright? Copyright is a form of protection provided by the laws of the United States (title 17, U.S. Code) to the authors of “original works of authorship,” including literary, dramatic, musical, artistic, and certain other intellectual works. This protection is available to both published and unpublished works. Section 106 of the 1976 Copyright Act generally gives the owner of copyright the exclusive right to do and to authorize others to do the following:

3 To reproduce the work in copies; To develop other works based upon the work; To distribute copies of the work to the public by sale or other transfer of ownership, or by rental, lease, or lending; To perform the work publicly, choreographed dances, pantomimes, plays To display the copyrighted work publicly, as in sculptures, paintings, movies, Photographs, written works Owners of Copyright are allowed…

4 What is not protected by Copyright? © Works that have not been fixed in a tangible form of expression (for example, choreographic works that have not been notated or recorded, or improvisational speeches or performances that have not been written or recorded) © Titles, names, short phrases, and slogans; familiar symbols or designs; mere variations of typographic ornamentation, lettering, or coloring; mere listings of ingredients or contents © Ideas, procedures, methods, systems, processes, concepts, principles, discoveries, or devices, as distinguished from a description, explanation, or illustration © Works consisting entirely of information that is common property and containing no original authorship (for example: standard calendars, height and weight charts, tape measures and rulers, and lists or tables taken from public documents or other common sources)

5 What is Fair Use? If a person wishes to use part of someone else’s work they have to obtain written permission from the author of that original work. Only in “fair use” cases do you not have to obtain this. The courts created fair use guidelines for teachers and students. This “policy” permits those of us working the school setting to “borrow” parts of an original work without obtaining written permission from the author. There are four basic guidelines used for the fair use policy- purpose, nature, amount and effect. Here are some of the acceptable and unacceptable uses:

8 Copyright Infringement Copyright infringement is the violation of the rights secured by a copyright, or using someone’s copyrighted material without permission.

9 What is the Purpose of Copyright? Many people view copyright laws as restrictions on what they can do with someone else's creative work. In the short term, U.S. copyright law does place restrictions on the use of creative works, setting up tension between the producers of information and entertainment resources and the consumers of that information. In the long term, however, the purpose of copyright law is to promote learning and creativity. The U.S. Constitution and the various copyright and patent laws enacted by Congress aim to maintain a balanced environment in which people are encouraged to create new works, and in which, eventually, a work enters the public domain, becoming freely available to all.
