PURPOSE To share information on the state of NPOs in Mpumalanga Province and To share the outcomes of the District and Provincial Dialogues held in July 2012

LEGISLATIVE MANDATE Definition of an NPO An organisation established for public purpose Prohibited from distributing income and property amongst its members or Office Bearers. Section 24 requires a register of all registered NPOs

SIZE AND SCOPE OF REGISTERED NPOS IN THE PROVINCE By end of March 2012, a total of 5131 were registered in Mpumalanga This is 6% of the total NPOs registered nationally.

REGISTRATION GROWTH RATE Mpumalanga Province experienced an average of about 20% over the years

ISSUES RAISED DURING THE DISTRICT & PROVINCIAL DIALOGUES … Theme1:Legislative /Regulatory Framework ISSUES RAISEDRECOMMENDATIONS NPO Act deals with all NPOs uniformly, it does not acknowledge different types of NPOs with various governance structures Lack of clarity on registration of NPO with Organization with two objectives i.e. HCBC/MPC ) using one NPO registration certificates Disqualifying registration of NPOs when Board members are of the same surname Time frame for NPO registration (3 months waiting period) is too long Language used on the registration forms are not user friendly, add other African languages Legislation need to be reviewed It should create different categories of NPOs to enable all NPO to comply with the legislation NPO Directorate to accept and register organisations with Board members of same surname because NPOs understand its own community dynamics Reduce time frame for NPO registration to 1 month (must draw lesson from DTI –”CIPRO”) Application forms for registration should be translated into all South African Languages

ISSUES RAISED DURING THE DISTRICT & PROVINCIAL DIALOGUES Theme1:Legislative /Regulatory Framework ISSUES RAISEDRECOMMENDATIONS NPOs do not have a body that advocate for their interest Limited accessibility of the National NPO office Lack of feedback or acknowledgement from National when narrative and financial reports have been sent Interference by Departmental officials on NPOs operations Co-opted Board members are fraudulent NPO regulatory body should be established to deal with NPO issues and challenges National NPO Directorate to create a call centre to deal with NPOs direct and establish satellite office for easy access of information NPO Directorate to create free and accessible online registration NPOs should be allowed to have its own bi-laws Scrutinize the Board members’ financial background

ISSUES RAISED DURING THE DISTRICT & PROVINCIAL DIALOGUES Theme2: Transformation of welfare services(10 point plan) ISSUES RAISEDRECOMMENDATIONS Rebuilding of Families Communities are neglecting their own cultures and values and no longer taking care of extended families Comprehensive Social Security System Grants fail to provide sustainable income to households HIV and AIDS and Special needs Inaccessibility of information for people with disabilities Addressing violence on children, older persons & vulnerable groups Lack of knowledge on the legislations by communities Family enrichment, gathering and reunion programmes should be developed and funding made available Encourage communities to go back to farming Grants to be utilized to create sustainable projects and create jobs Develop documents in Braille and training on sign language interpreters Create awareness on all legislations regarding children, older persons and vulnerable groups

ISSUES RAISED DURING THE DISTRICT & PROVINCIAL DIALOGUES Theme2: Transformation of welfare services(10 point plan) ISSUES RAISEDRECOMMENDATIONS Youth Development Lack of knowledge on legislations and policies for youth Information is not properly disseminated to young persons Accessibility on social welfare services Lack of experience of Social Auxiliary workers Rural areas and farms not well serviced Issues raised for DSD to include in their services: Substance and alcohol abuse, crime and teenage pregnancy and domestic violence. Awareness campaigns on youth legislations and policies must be conducted Review NYDA policies In –service training to Social Auxiliary Workers to be conducted DSD to reach out to all rural and farm communities

Theme 3 :Resource Mobilization (PFA) ISSUES RAISEDRECOMMENDATIONS Lack of knowledge on the Policy of Financial Award by NPOs and officials Delays in the transfers of funds and grants to NPOs which cause perpetual extreme hunger and poverty and bad management of NPOs Subsidies are not increasing with inflation Lack of communication to NPOs when there is reduction of funds which results in decreasing of the number of beneficiaries, poor care of frail older persons, etc. Post funding is not able to cover the running cost of the organizations DSD to capacitate and conduct campaigns on the Policy of Financial Award for officials and NPOs DSD to develop a mechanism to avoid delays in subsidy payments DSD to communicate shortage of budget on time Increase funding in line with inflation NPO to establish and participate in local NPO forums Priority for funding to be given to rural areas Reconsider funding models

ISSUES RAISED DURING THE DISTRICT & PROVINCIAL DIALOGUES Theme 3 :Resource Mobilization (PFA) ISSUES RAISEDRECOMMENDATIONS NPOs e.g. ECDs await too long for approval for funding and those in the backrooms not considered for funding Annual submission of business plan for funding NPOs lack fundraising skills to sustain themselves and alleviate poverty Lack of consistency and change of NPO staff leads to loss of crucial documents DSD to reconsider funds that were cut and extension of services to be financed Needs based programmes should be implemented on a long-term basis (3 year funding) Intensify capacity building of NPOs

ISSUES RAISED DURING THE DISTRICT & PROVINCIAL DIALOGUES Theme4 :Additional issues ISSUES RAISEDRECOMMENDATIONS Difficulty to access land for NPO activities and delays by municipality to provide sites Lack of skills by NPO members, especially basic administration and financial management Lack of feedback to NPOs after officials have conducted monitoring Favoritism of organizations by officials Hostile relations presented by officials towards NPOs Lack of fringe benefits for NPO workers e.g. housing allowances, pension fund and medical aid The funders to have a memorandum of agreement with municipality to allocate sites for NPOs Enhance capacity building to NPOs DSD officials to be part of solutions and not be hostile (policing) towards NPOs and should be passionate about the work Professionalization of NPO practitioners should be considered

Conclusion The department has noted the challenges and recommendations by the NPOs. The department therefore commits to partner with the NPOs in finding ways to address the challenges.
