14 Planning Permission Process  Application for permission is made to the Planning Authority (Local Authority)  There are three parties to the planning process ─ Applicant ─ Planning Authority ─ Public  Planning Authority makes a decision to approve or refuse permission  Appeals process run by An Bord Pleanála

15 Planning Application  Completed Application Form  Location Map  Site Plan (1:500)  Other Plans, Sections, Elevations etc. (1:100)  Application fee  Part V option must be stated for residential developments, i.e. social and affordable housing provision Note: Where all information required is not submitted the Planning Authority may invalidate the application

16 Planning Notices Public Notices  Newspaper Notice ─ Within two weeks before application  Site Notice ─ No earlier than two weeks before lodging application, must remain in place for 5 weeks from receipt of application.

17 Submitting Comments on Planning Applications  Everyone has a right to view and comment on a planning application  Only written comments have to be considered by Planning Authority  Written comments must be submitted within 5 weeks of application date with fee €20  A person that has not submitted a written comment within 5 weeks cannot appeal the decision to An Bord Pleanála Note: A copy of a planning application may be purchased from the Planning Authority.

18 Decision on Planning Application  Time Period ─ Must be made by Planning Authority within 8 weeks unless additional information requested  Planning Authority must: ─ assess application in accordance with the Development Plan and Government Guidelines ─ consider whether it is in accordance with ‘proper planning and sustainable development’ and in the interests of the ‘common good’ ─ consider the comments submitted

19 Planning Decision by Planning Authority Two Options:  Approval: Notification of Grant of Permission with or without conditions ─ Reasons for conditions must be given ─ If decision is not appealed to An Bord Pleanála a Grant of Permission is issued in 4 weeks  Refusal: Notification of Refusal of Permission is issued ─ Reasons for refusal must be given ─ If not appealed, a decision to refuse is issued

20 Appeals to An Bord Pleanála Appeals on Planning Decisions may be made by:  Applicant ─ Against refusal ─ Against conditions on the decision to grant  Third Parties ─ Against the decision to grant permission ─ Appeal any condition

23 Environment Impact Assessments (EIA) EIA Required for:  Large Scale Development  Development with a particular risk  Thresholds – European Union EIA Regulations  Projects requiring and integrated Pollution Control Licence or a Waste Licence

24 Environment Impact Assessments (EIA) Environmental Impact Statement (EIS)  Prepared by Applicant lodging planning application  Includes: ─ Description of Development ─ Assessment of Environmental Effects ─ Proposed measures to reduce / eliminate effects  Must submit a non-technical summary in addition to the main report
