2. Update on the CPR 2 There is preliminary agreement in trilogues on the blocks on major projects and revenue generating operations/PPPs Both blocks are subject to discussion and agreement in COREPER 26 June Certain issues that have proven to be challenging will hopefully be resolved

3. Legal framework (1) Legal framework in this area is challenging because: 1)There is a set of relevant empowerments, which overlap or are closely linked: For major projects under cohesion policy only Formats for major projects (+) The methodology for the CBA (+) The methodology for carrying out quality review of a major projects (Article 91 (1) CPR, forthcoming – links with CBA methodology) For operations generating revenue after their completion Methodology for the calculation of net revenue (+, Article 54, overlaps with the CBA for major projects ) Flat rate revenue percentages to be established by delegated acts (link with CBA for major projects) Empowerments for PPPs (rules on the change of beneficiary, minimum requirements for PPP agreements) 3

4. Legal framework (2) 4 2) Legal form and adoption procedure for all these acts has not been clear. Legal form also affects the content of the act and how links should be built between these acts. 3) Drafting of "an indicative guidance on a methodology" in the form of a binding legal act is a challenge. Hopefully resolved with agreement on the revised legal text in COREPER.

Next steps 5 For methodologies Review and revision of the fiche and the content of the acts in the light of the text agreed between co-legislators Review of comments by MS experts following the meeting Preparation of the IA on methodology for quality review Another discussion in expert group in September For major project formats: This discussion is hopefully the last one at expert group level. Followed by finalisation taking into account any changes in legal text and the remaining comments from experts.
