6 What is a “Road”? “The word ‘roadless’ refers to the absence of roads which have been improved and maintained by mechanical means to insure relatively regular and continuous use. A way maintained solely by the passage of vehicles does not constitute a road.” House Report 94-1163; May 15, 1976 Inventory - Boundary

8 What is a “Road”? Inventory - Boundary A route which has been improved and maintained by mechanical means to insure regular and continuous use = wilderness inventory road

9 What is a “Road”? Inventory - Boundary  “Improved and maintained”  physical action taken to keep road open to vehicle traffic  “improved” construction not necessarily formal  “maintained” not necessarily annual  “maintained” not necessarily regular  “maintained” as necessary to keep open

10 What is a “Road”? Inventory - Boundary  “Mechanical means”  power machinery  hand tools  NOT just hands or feet

11 What is a “Road”? Inventory - Boundary  “Relatively regular and continuous use”  vehicular use  has occurred and will continue to occur  E.g., access roads to stock tanks, mining claims, recreation facilities

12 What is a “Road”? Inventory - Boundary must meet all three conditions:  improved and maintained  by mechanical means  relatively regular and continuous use

13 What is a “Road”? Inventory - Boundary NOT a road if:  established by the passage of vehicles – even if regularly used mechanical construction but no maintenance – unless:  no maintenance is necessary AND  road would be maintained if necessary
