15 WHY? We encourage the use of Minority and Womens Business Enterprises on State of Indiana Contracts to bridge the gap between Capacity and Utilization The Commission on Minority and Womens Business Enterprises is required to submit a semi-annual report of committed utilization to the Governor and the Legislature Utilizing M/WBEs

16 Procurement Professionals are encouraged to solicit at least one of the three required quotes from MWBEs Example: Indiana Department of Homeland Security has it built into their metrics Probe Procurement Department Metric, Soliciting Quotations from Indiana and MBE/WBE vendors Utilizing M/WBEs Government Agencies

23 IDOA Contract Boilerplate Language for Professional Services on RFP/RFS: The Contractor agrees to submit a copy of the agreement entered into between the Contractor and each MBE / WBE subcontractor where the State took the selection of the MBE / WBE by the Contractor into consideration when issuing the procurement award. Post Contract Award

24 IDOA Contract Boilerplate Language for Professional Services on RFP/RFS and IDOA M/WBE Participation Policies for Construction: Proposes MBE and WBE Contract Goals become incorporated into and a requirement of the Contract. Contractors shall not substitute, replace or terminate any MBE and WBE without prior written authorization from MWBED and the M/WBE Post Contract Award

25 Prime Contractors are required to honor the Participation Plan or Subcontractor Commitment Form as part of the Contract MWBED Compliance Team analyzes the Committed Spend on the Participation Plan against Actual Spend Primes in non-compliance may face sanctions Monitoring Compliance
