3 Transportation: Accidents From Impairment Substance Abuse Alcohol was the most prevalent drug, found in 52% of vehicle accidents. Alcohol, marijuana, heroin, cocaine and amphetamines are responsible for most trucking accidents. Fatigue / sleep-deprivation Fatigue contributes to numerous accidents.

5 Transportation: Liability In 2006, a Swift Transportation driver on meth was involved in a highway wreck with a Yellow Freight truck: $23.5 million verdict for one YF employee who suffered catastrophic spinal cord injury. A wrongful death trial is still pending for the other YF employee.

6 Transportation: “Direct Observation Rule” In May 2009, a court decision supported the US DOT requirement for transportation industry employers to implement the Direct Observation Rule for Return-to-Duty and Follow-up testing 73 Fed. Reg. 62,910, 62,918 Adulteration of urine samples collected for drug and alcohol screening has significantly increased among workers. Employees who elect not to participate in drug & alcohol screening shall be treated as a positive test and required to demonstrate that they are drug free before returning to work. √ ESP will help employers by providing solid, quantifiable, reasonable-suspicion indicators.

7 Substance Abuse Testing Exceeding minimum federal requirements is always beneficial. –Current testing procedures are invasive, slow and costly. –Testing can easily cost $100 per test.
