The National Risk Protection Programme Public Liability Club Management LiabilityPersonal Accident  Basic aspects of coverage  Claims Examples  The role of your organisation in the Insurance programme

Public Liability  What is it?  Protection for your club if you are sued for personal injury or property damage arising from your alleged negligence.  Addresses investigation and representation costs, as well as any financial settlement required.  Risk management is paramount is satisfying your club’s duty of care.  $1,000 excess per claim applies.

Public Liability  Claim examples 1.Football kicked into crowd, causing injury to spectator. 2.Spectator falls down stairs of your clubhouse and injures himself. 3.Player runs over sideline into the boundary fence and cuts himself on perimeter fencing.

Club Management Liability  What is it?  Protection for your office bearers and club if accused of a wrongful act or breach of professional duty. Also has provisions for fidelity (theft by employee/volunteer).  Due diligence is required to ensure that the policy responds as intended.  Variable excesses (nil - $5,000) per claim.

Club Management Liability  Claim Examples 1.Club is sued by coach for wrongful dismissal (employment practices liability) 2.President is sued for defamation following comments published in the club’s newsletter or matchday program. 3.Treasurer embezzles registration monies, resulting in financial loss to the club.

Club Management Liability  Due diligence 1.Appropriate controls and measures -dual signatories on bank accounts -audits of finances -adherence to policies and procedures 2.Report any suspected loss as soon as discovered -no cover for subsequent losses -policy is insured on a “claims made” basis – if it isn’t notified, the insurer can refuse to indemnify the claim.

Personal Accident  What is it?  Protection for players, coaches, trainers, officials, volunteers in the event of suffering an injury while acting on behalf of the club.  Cover across 3 main areas: -Capital Benefits -Non-Medicare Medical expenses -Loss of income (optional cover)  Upgraded cover is available (AFLQ upgrades all teams to platinum)

Personal Accident  What is NOT Covered?  Medicare related costs, including the Medicare gap, can not be insured under the AFL programme.  Costs incurred once a player is able to resume playing.  Spectator injuries.

Personal Accident and Private Health Insurance  JLT strongly recommends all players consider purchasing private health insurance  The personal accident policy provides a base level of cover only, out of pocket costs can still be significant.

Impact of Private Health Insurance Figures based on an average of 10 claims at a leading PHI fund * figures based on Bronze and Silver JLT cover + highest cost of a treatment over a 12 month period at a leading PHI fun

Personal Accident  Your role  Monitor your injured players where possible.  Ensure that companies that act on behalf of the club are familiar with the policies in place  Some physios do take advantage of over- treating injured players  Follow up - are claims finalised once the player returns to the field?  Approx. 20% of claims costs are due to over-servicing  = 20% impact on premiums

Thank you
