3 FIRST AMENDMENET Congress shall make no law... abridging (preventing or limiting) the freedom of speech or press. Article 6, Section 2 The Constitution, and the laws of the United States (federal)... shall be the supreme law of the land.

4 FACT: Alien Sedition Acts violates the First Amendment rights to freedom of speech and press. Democrat-Republicans: Because the Alien Sedition Acts violated the First Amendment rights, Jefferson/Madison issued the Virginia Kentucky Resolutions: the states have the right to “nullify” (cancel) or ignore federal laws if they think it violates their rights. Do states have the right to ignore a federal law? FACT: Virginia and Kentucky Resolutions violated Article 6, Section 2, which states that all federal laws MUST be obeyed by every state. If states can ignore whatever law they want, then there’s no point to having a federal government. What kind of government would that look like, when states have more power than the federal government and could basically do what they want? The Articles of Confederation! Conclusion: Just because a law is illegal doesn’t mean you have the right to pass another illegal law. So both groups were wrong and both violated the Constitution.

5 ALIEN AND SEDITION ACTS Created by Federalists to punish Democratic Republicans. Unconstitutional because it violated the first amendment rights to freedom of speech and press. VA & KY RESOLUTIONS States can ignore Fed. Law if they think it’s unconstitutional. But these resolutions also violates the constitution. According to Art. 6, Sec. 2, federal law is supreme, so EVERYONE has to obey! This would look too much like the AOC, when states could choose whether or not to obey federal law

6 States can disagree with a federal law but states can’t decide if a law is constitutional or unconstitutional. That responsibility has been given to the Supreme Court only.
