6 CONSUMER PROTECTION LEGISLATION

7 Consumer protection Businesses must never be misleading about their products The law gives customers protection against unfair selling practices. You do not need to know specific Acts but you do need to understand how fair trading regulations protect consumers. The consumer has basic legal rights if the product is: given a misleading description of an unsatisfactory quality not fit for its intended purpose Video on coca Cola’s Vitamin water and claims it was misleading customers herehere

9 Unfair trading regulations 2008 The Unfair trading regulations makes it an offence for a trader to make false or misleading statements about goods or services. It carries criminal penalties and is enforced by Trading Standards Officers, making it an offence for a trader to: Apply a false trade description to any goods Use aggressive door to door sales techniques

19 Sale of Goods Act 1979 This Act says that all products have to be of a 'satisfactory quality'. 22 Working time Regulations Act a limit of an average of 48 hours (though workers can choose to work more if they want to) a limit of an average of 8 hours work in 24 which night workers can be required to work right for night workers to receive free health assessments right to 11 hours rest a day right to a day off each week right to an in-work rest break if the working day is longer than 6 hours right to 4 weeks paid leave per year NHS struggled to implement this law article herehere

25 Environmental protection Act 1990 Introduced a system of integrated control for the disposal of waste to land water and air Business now has a duty to recycle and face criminal penalties if they fail to co-operate with their council’s recycling arrangementspenalties This applies to all waste and control of emissions Business now has a duty of care in respect of dealing with their waste, including IT waste

26 COMPETITION POLICY LEGISLATION

27 Competition Act 1998 Legislation in place by the government designed to prevent collusion – price fixing by businesses getting together and agreeing a price to charge for their products CMA is the competition and Markets Authority who are independent regulators The CMA aims to “promote competition for the benefit of consumers” see website herehere They investigate mergers that restrict competition

28 HEALTH AND SAFETY LEGISLATION

29 Health and Safety at Work Act 1974 Aims to raise the standard of safety and health for all individuals at work, and to protect the public whose safety may be put at risk by the activities of people at work Places responsibility on employers and employees If either fail to comply they can be taken to court and fined The Act is backed by the HSE See full poster PDF herehere

30 The Factories Act 1961 Applies to all premises where 2 or more people are employed in manual labour Includes garages to engineering works Sets out to ensure that minimum standards of cleanliness, space for people to work, temperature and ventilation, lighting, conveniences, clothing, accommodation and first-aid facilities are maintained
