Also referred to as a GSA Schedule or a Federal Supply Schedule (FSS) A 5 year Indefinite Delivery Indefinite Quantity (IDIQ) contract with 3 five year options (up to 20 year contract) 20,000+ individual contracts awarded providing access to millions of commercial products/services $48 billion total annual spend  How is a Schedule awarded? It is a negotiated contract based on evaluation criteria of fair and reasonable pricing, financial responsibility, past performance, and past experience; spot discounting allowed 5

9 Multiple Award Schedules Training Funding for State and Local 9 ❑ Receiving Federal grant funds does not: Make otherwise ineligible activities eligible to purchase under Schedules, nor Allow access to Schedules outside of approved programs. ❑ The current S&L programs, excluding the Public Health Emergency (PHE) authority which is limited to Federal grant funds, allow for use of all sources of funding ❑ When purchasing with grant funds, you MUST follow all grant requirements, including competition requirements

13 Multiple Award Schedules Training Authority for Cooperative Purchasing The two main authorities for the Cooperative Purchasing program are:  Public Law 107-137: Section 211 of the e-Gov Act of 2002, which allows purchase from Schedule 70  Public Law 110-248: Local Preparedness Acquisition Act, which allows purchase from Schedule 84 13

14 Multiple Award Schedules Training Eligibility Eligible Users per 40 U.S.C § 502 (c) offers the following definition of State or Local government: 14 “… any State, local, regional, or tribal government, or any instrumentality thereof (including any local educational agency or institution of higher education)."

30 Multiple Award Schedules Training Scope of the Disaster Recovery Program  This program authorized State and Local governments access to ALL Federal Supply Schedules, when purchasing to facilitate recovery from major disasters  It applies to purchases made in advance or in the aftermath of Presidentially-declared disasters or acts of terrorism  State and Local entities may use GSA Schedules to purchase in advance of a major disaster declared by the president, as well as in the aftermath of an emergency event 30

The 1122 Program, authorized under the 1994 Defense Authorization Act and amended by the 2009 National Defense Authorization Act allows: "...States and units of local government to purchase equipment suitable for counter-drug, homeland security, and emergency response activities through the Department of Defense. 39

40 Multiple Award Schedules Training Definitions under 1122 Program (1) The term ''State'' includes the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, and any territory or possession of the United States. (2) The term ''unit of local government'' means any city, county, township, town, borough, parish, village, or other general purpose political subdivision of a State; an Indian tribe which performs law enforcement or emergency response functions as determined by the Secretary of the Interior; or any agency of the District of Columbia government or the United States Government performing law enforcement or emergency response functions in and for the District of Columbia or the Trust Territory of the Pacific Islands. 40

The 1122 Program provides equipment to its customers through three separate federal sources:  Department of Army or Defense Logistics Agency (DLA) stocked items – to the appropriate supply center  Commercial items directly with the Multiple Award Schedule Contractor (GSA)  Vehicles – ordered through GSA AutoChoice 42

43 Multiple Award Schedules Training Terms and Definitions What is the “Definition” of “Counter-Drug”?  INTERDICTION – To destroy or interrupt; Halt the enemy’s advance; A prohibition by court order.  ERADICATION – To pull or tear up by or as if by the roots; To get rid of completely.  PREVENTION – To keep someone from doing something; To anticipate or counter in advance  EDUCATION – To provide with training or knowledge; To stimulate or develop the mental or moral growth of. 43

What is the “Definition” of an “Emergency Responder”? “First responders plus emergency management, public health, clinical care, public works, and other skilled support personnel (such as equipment operators) that provide immediate support services during prevention, response, and recovery operations. The emergency responder community consists not just of fire, law enforcement, and medical immediate responders to an accident or emergency situation but also to the infrastructure that supports them and other emergency response organizations.” – Definition by DOD 44

45 Multiple Award Schedules Training Contractor Responsibility What is the contractor’s responsibility when selling products to 1122 Program Participants at GSA Pricing?  The product is on one of the Schedules/SINs approved by GSA for the 1122 Program  Verify if the state in which the purchasing agency is located has an appointed State Point of Contact (SPOC) and identify them. Refer purchasing agency to their SPOC for facilitation of the purchase in accordance with the program procedures for their state.  All orders being placed through the 1122 Program are to include the statement, “This order is placed pursuant to the State and Local Law Enforcement Equipment Procurement Program (“1122 Program”) in support of counter-drug, homeland security, and emergency response activities, under the authority of the State Point of Contact (SPOC) for the State of _______________.” 45

Disaster Recovery Purchasing Program The States of the United States, counties, municipalities, cities, towns, townships, tribal governments, public authorities (including public or Indian housing agencies under the United States Housing Act of 1937), school districts, colleges, and other institutions of higher education, council of governments (incorporated or not), regional or interstate government entities, or any agency or instrumentality of the preceding entities (including any local educational agency or institution of higher education), and including legislative and judicial departments. State and local agencies may use all GSA Schedules to purchase products and services before and after a major disaster as declared by the President. Cooperative Purchasing Program The States of the United States, counties, municipalities, cities, towns, townships, tribal governments, public authorities (including public or Indian housing agencies under the United States Housing Act of 1937), school districts, colleges, and other institutions of higher education, council of governments (incorporated or not), regional or interstate government entities, or any agency or instrumentality of the preceding entities (including any local educational agency or institution of higher education), and including legislative and judicial departments. State and local agencies are granted access to products and services offered on Schedule 70, 84 and IT Special Item Numbers on the Consolidated Schedule. These two schedules can be used for any reason at any time. 65
