4 4 ADA Overview  Americans with Disabilities Act (ADA) was signed into law by President George H. W. Bush on July 26, 1990.  The history of ADA did not begin on July 26, 1990 at the signing ceremony at the White House.  It did not begin in 1988 when the first ADA was introduced in Congress.

5 5 ADA Overview The ADA story began a long time ago in cities and towns throughout the U.S.  When people with disabilities began to challenge societal barriers that excluded them from their communities.  When parents of children with disabilities began to fight against the exclusion and segregation of their children.

6 6 ADA Overview Many thousands of people worked for years organizing and attending protests, licking envelopes, sending out alerts, drafting legislation, speaking, testifying, negotiating, lobbying, filing lawsuits, being arrested - doing whatever they could for a cause they believed in.

7 7 ADA Overview  The disability rights movement, over the last couple of decades, has made the injustices faced by people with disabilities visible to the American public and to politicians.  The disability rights movement adopted many of the strategies of the civil rights movement.

8 8 ADA Overview  From a legal perspective, a profound and historic shift in disability public policy occurred in 1973 with the passage of Section 504 of the 1973 Rehabilitation Act, which banned discrimination on the basis of disability by recipients of federal funds.  The Department of Health, Education and Welfare (HEW) issued Section 504 regulations on May 4, 1977.  In April 1988, the first version of ADA was introduced to the 100 th Congress.

9 9 ADA Overview  Title II of the ADA covering State and Local Government passed on January 26, 1992.  Title III of the ADA covering Public Accommodations passed on January 26, 1992.  The effective date for the employment provisions in Title I of the ADA approach on July 26, 1992.  More than fifty million Americans have some kind of physical, sensory, cognitive, or mental disability (as of the 20 th ADA Anniversary).

13 13 Key Points to Remember The new standards set requirements for:  New Design and Construction  Altered State & Local Government Facilities  Public Accommodations  Commercial Facilities

14 14 Key Points to Remember Exception: Exceptions for Structural Impracticability will be considered in rare circumstances. Alteration: Alterations for public entity shall be made in such a manner that facility is readily accessible to individuals with disabilities.

15 15 Key Points to Remember Path of Travel: The Path of Travel to altered area and the restrooms, telephones, and drinking fountains serving altered area are readily accessible to individuals with disabilities. Safe Harbor: A provision of a regulation that reduces a party's liability under the law, on the condition that the party performed its actions in good faith or in compliance with defined standards.

16 16 Key Points to Remember Incremental Changes: Small changes to existing standards. For example, Max. side reach was 54" AFF in 1991 Standards. Max. side reach is 48" AFF in 2010 Standards. Supplemental Changes: These changes are New Requirements. Note: Supplemental Changes are not covered by a Safe Harbor.

18 18 The 2010 ADA Standards Carpet:  The carpet or carpet tile shall have a firm cushion, pad, or backing or no cushion or pad.  The pile height of carpet or carpet tile shall be ½" max.  Exposed edges shall be fastened to floor surfaces and shall have trim on the entire length of exposed edge.

19 19 The 2010 ADA Standards Change in Level:  Change in level of ¼" high max. shall be permitted to be vertical.  Change in level between ¼" high min. and ½" high max. shall be beveled with a slope not steeper than 1:2.  Change in level greater than ½" high shall be ramped.

20 20 The 2010 ADA Standards Change in Level:

21 21 The 2010 ADA Standards Turning Space:  Circular turning space shall be of 60" dia. min.  T-Shaped turning space shall be a 60" square min. with arms and base 36" wide min.  Doors shall be permitted to swing into turning spaces.

22 22 The 2010 ADA Standards Maneuvering Clearance:  Clear floor or ground space shall be 30" min. by 48" min.  Clear floor or ground space shall be permitted to include knee and toe clearance.

23 23 The 2010 ADA Standards Toe Clearance:  Space under an element between the finish floor and 9" above the finish floor shall be considered toe clearance.  Toe clearance shall extend 25" max. and 17" min. under an element.  Toe clearance shall be 30" wide min.

24 24 The 2010 ADA Standards Knee Clearance:  Space under an element between 9" and 27" above the finish floor shall be considered knee clearance.  Knee clearance shall extend 25" max. and shall be 11" deep min. @ 9" above finish floor and 8" deep min. @ 27" above finish floor.  Knee clearance shall be 30" wide min.

25 25 The 2010 ADA Standards Knee Clearance: Pipes must be insulated or pipe protection provided

26 26 The 2010 ADA Standards Protrusion Limits:  Objects with leading edges more than 27" and not more than 80" above the finish floor shall protrude 4" max. horizontally into the circulation path.  Exception - Handrails shall be permitted to protrude 4½" max.

27 27 The 2010 ADA Standards Vertical Clearance:  Vertical clearance shall be 80" high min.  Guardrails or other barriers shall be provided where the vertical clearance is less than 80" high.  The leading edge of such guardrail shall be 27" max. above the finish floor.

28 28 The 2010 ADA Standards Reach Ranges:  Unobstructed – The high forward & side reach shall be 48" max. and low forward & side reach shall be 15" min. above finish floor.

34 34 The 2010 ADA Standards Accessible Routes – Walking Surfaces:  The running slope of walking surfaces shall not be steeper than 1:20.  The cross slope of walking surfaces shall not be steeper than 1:48.  The clear width of walking surfaces shall be 36" min.  The clear width exception permitted.

35 35 The 2010 ADA Standards Accessible Routes – Walking Surfaces:  The clear width shall be permitted to be reduced to 32" min. for a length of 24" max. provided that the reduced width segments are separated by segments that are 48" long min. and 36" wide min.

36 36 The 2010 ADA Standards Accessible Routes – Walking Surfaces:  Accessible route that makes 180 degree turn around an element less than 48" wide, the clear width shall be 42" min. approaching the turn, 48" min. at the turn and 42" min. leaving the turn.

37 37 The 2010 ADA Standards Accessible Routes – Doors:  Door openings shall provide a clear width of 32" min. Note: Revolving doors, revolving gates and turnstiles shall not be part of an accessible route.

39 39 The 2010 ADA Standards Accessible Routes – Doors:  The distance between two hinged or pivoted doors in series shall be 48" min. plus the width of doors swinging into the space.

40 40 The 2010 ADA Standards Accessible Routes – Ramps:  Ramp runs shall have a running slope not steeper than 1:12.  Cross slope of ramp runs shall not be steeper than 1:48.  The rise of any ramp shall be 30" max.  Ramps shall have landings at the top and the bottom of each ramp run.

41 41 The 2010 ADA Standards Accessible Routes – Ramps:  Landing width shall be at least as wide as the widest ramp run leading to the landing.  Landing clear length shall be 60" min.  Ramp runs with a rise greater than 6" shall have handrails.  The clear width between handrails shall be 36" min.

42 42 The 2010 ADA Standards Accessible Routes – Ramps:  Ramp slope exception permitted in existing buildings and facilities due to space limitations. SlopeMaximum Rise Steeper than 1:10 but not steeper than 1:83" Steeper than 1:12 but not steeper than 1:106" Note: A slope steeper than 1:8 is prohibited.

45 45 The 2010 ADA Standards Accessible Routes – Elevators:  Elevator call buttons and keypads shall be located within the Reach Ranges measured to the centerline of the highest operable part.  Call buttons shall be ¾" min. in the smallest dimension.  Call button shall be raised or flush.

48 48 The 2010 ADA Standards Stairways:  All steps shall have uniform riser heights and tread depths.  Riser shall be 4" high min. and 7" high max.  Treads shall be 11" deep min.  Open risers are not permitted.  Handrails shall be provided on both sides of stairs where required.

49 49 The 2010 ADA Standards Handrail:  Gripping surface of handrails shall be 34" min. and 38" max. vertically above walking surfaces, stair nosing, and ramp surfaces.

50 50 The 2010 ADA Standards Handrail:  Clearance between handrail gripping surfaces and adjacent surfaces shall be 1½" min.  Handrail gripping surface shall not be obstructed along their tops or sides.  Horizontal projections shall occur 1½ " min. below the bottom of the handrail gripping surface.

51 51 The 2010 ADA Standards Handrail:  Handrail gripping surface with a circular cross section shall have an outside dia. of 1¼" min. and 2" max.  Handrail gripping surface with a non-circular cross section shall have a perimeter dimension of 4" min. and 6¼" max. and a cross section dimension of 2¼" max.

52 52 The 2010 ADA Standards Handrail:  Ramp handrails shall extend horizontally above the landing for 12" min. beyond the top and bottom of ramp runs.

53 53 The 2010 ADA Standards Handrail:  At the top of stair flight, handrails shall extend horizontally above the landing for 12" min. beginning directly above the first riser nosing.

54 54 The 2010 ADA Standards Handrail:  At the bottom of stair flight, handrails shall extend at the slope of the stair flight for a horizontal distance at least equal to one tread depth beyond the last riser nosing.

56 56 The 2010 ADA Standards Plumbing:  The centerline of the water closet shall be 16" min. to 18" max. from the side wall. Water closet shall be 17" min. to 19" max. from the side wall in the ambulatory accessible toilet compartment.

57 57 The 2010 ADA Standards Plumbing:  Clearance around water closet shall be 60" min. measured perpendicular from the side wall and 56" min. measured perpendicular from the rear wall.

58 58 The 2010 ADA Standards Plumbing:  Side wall grab bar shall be 42" long min. located 12" max. from the rear wall and extending 54" min. from the rear wall.

59 59 The 2010 ADA Standards Plumbing:  Rear wall grab bar shall be 36" long min. and extend from centerline of water closet 12" min. on one side and 24" min. on the other side.

60 60 The 2010 ADA Standards Plumbing: 38" max. 32" min. wall reinforcement or blocking

61 61 The 2010 ADA Standards Plumbing:  Paper dispenser shall be 7" min and 9" max. in front of the water closet measured to the centerline of dispenser. Dispenser shall be 15" min. and 48" max. above the finish floor.

63 63 The 2010 ADA Standards Plumbing:  Wheelchair accessible compartments shall be 60" wide min. and 56" deep min. for wall hung water closets and 59" deep min. for floor mounted closets.

64 64 The 2010 ADA Standards Plumbing:  Provide a toe clearance of 9" min. above the finish floor for adults. Provide a toe clearance of 12" min. above the finish floor for children.

65 65 The 2010 ADA Standards Plumbing:  Urinal shall be stall-type or wall-hung type with rim 17" max. above floor finish and shall be 13½" deep min. from outer face of rim to the back of fixture.

67 67 The 2010 ADA Standards Plumbing:  Grab bar with a circular cross sections shall have an outside dia. of 1¼" min. and 2" max.  Grab bar with a non-circular cross section shall have a perimeter dimension of 4" min. and 4.8" max. and a cross section dimension of 2" max.

68 68 The 2010 ADA Standards Plumbing:  The seat height of a water closet above the finish floor shall be 17" min. and 19" max. measured to top of the seat.  Grab bars shall be provided on the side wall closest to the water closet and on the rear wall.  Grab bars shall be installed 33" min. and 36" max. above the finish floor to top of gripping surface.  Door shall not swing into the clear floor space or clearance required for any fixture.  Door shall be permitted to swing into the required turning space.
