4. Legislation The Health and Social Care Act 2008 Code of Practice for Healthcare

5. Health and Social Care Act 2008 From October 2010 independent health care providers and adult social care providers are required to register with the Care Quality Commission This Act sets out how all aspects of health and social care must be provided. Infection prevention and control is one part of this legislation

6. The Code of Practice for Healthcare The code of practice has been issued by the Department of Health and provides information for providers to ensure they are compliant with the requirements of the Health and Social Care Act 2008 The code of Practice has identified 10 criterion which a registered provider will be assessed against to ensure it complies with registration requirements for cleanliness and infection control

7. Legislation Control of Substances Hazardous to Health 2002 Reporting of Injuries, Diseases and Dangerous Occurrences RIDDOR 1995

8. Control of Substances Hazardous to Health COSHH 2002 The law requires employers to control substances that are hazardous to health. An employer must prevent or control exposure to hazardous substances. An employer can do this by: 1.Identifying what health hazards there may be. 2.Carrying out a risk assessment to prevent harm to health. 3. Providing control measures. 4. Ensuring the control measures are used.

Reporting of Injuries, Incidents and Dangerous Occurrences RIDDOR 1995 Legislation which provides a legal duty on employers, self employed people and people in control of premises To report work related deaths, major injuries, specific diseases and over 3 day absences due to work related conditions and near misses

11. Organisational policy Every organisation is required to have in place policies and procedures that will ensure they comply with all the legislation relevant to the control and prevention of infections
