6 Motivation for Guidance: Act of Parliament comes into force on 1.10.15 prepared in context of Caldicott 2 review “share for care” and other recent events To support consistent interpretation and seek to maintain momentum for change Purpose of Guide: Explanation of the 2 main parts of the Act: A requirement for health and adult social care organisations to use a consistent identifier (the NHS Number) for sharing data for direct care of a patient. A legal duty requiring health and adult social care bodies to share information with each other for the direct care of a patient Advertise active enquiry and rapid clarification IG Background for Guide: - Common Law Duty of Confidentiality Data Protection Act 1998 Practice framework for care professionals Statutory basis for organisations that provide care Guide to The Health and Social Care (Safety and Quality) Act 2015

7 Detail of Guidance The new act reinforces existing good practice and obligations on health and adult social care professionals Statutory duty requiring health and adult social care bodies to share information, where this will facilitate care for an individual (7th Caldicott principle - 'the duty to share information can be as important as the duty to protect the patient‘) Requirement for consistent use of a unique identifier, in this case the NHS number, for service users across health and adult social care Non-Confidential Personal Information - where information is personal but not held in confidence, there is a need to ensure that individuals have been informed about any proposed sharing and have not objected to it, but where this has been done the duty to share will have effect – practical use of this is not yet clear We are looking to develop case studies and further guidance on the basis of queries and discussions The Health and Social Care (Safety and Quality) Act 2015: Duty to share information Duty to Share Consistent Identifiers Practical Tips

8 Detail of Guidance Background to NHS number and legal basis for use Legal obligation on organisations that commission or provide health care or adult social care to include NHS Number, system-wide adoption to enable delivery of integrated care and integrated digital care record systems (NB - wherever practicable) Exclusions – use in care context, not as a general identifier Examples of appropriate care contexts outside of the NHS (please send in other examples) Common Law Requirements - ‘no surprises’ and limits of “implied consent” Data Protection Requirements - Schedule 2 (interest by any person) & Schedule 3 (wider interpretation of medical purposes) Guide to support use of the NHS number IG guide for use of NHS number Practical Tips
