Unit I – Reading: Summer Swimming Incident Unit I – Seminar (graded) - In this week’s seminar we will discuss the Syllabus, Course, and the Summer Swimming Incident Fact Scenario that we will be using throughout this course. Summer Swimming Incident – Undisputed Facts Shayla Smith is a ten year old juvenile Shayla Smith was the invited guest of the Tuttles on their camping trip to O&D Campgrounds Campground has a clean but murky pool with a sand bottom, no lifeguard, and no diving board No Security on the Campground Premises Pool opens at 10 AM. Incident took place around 9:30 AM before the pool opening. Sign at pool entrance noted that the pool opens at 10 AM. Girls went to the pool unsupervised

Summer Swimming Incident – Undisputed Facts (Continued) Tamara dove into the pool first without injury, but with the warning that the pool was shallow, then invited Shayla in. Shayla yelled “What?” After Tamara’s comments then dove in, hitting the bottom and breaking her arm. Tamara saved her from drowning by helping her to the bank Pool is marked a the shallow end by a sign that is put out at 10 AM when the pool opens. Sign was not in place when Tamara and Shayla got into the pool.
