2 2 Commission Open Data Package in context A strategy for smart, sustainable and inclusive growth A vision to achieve high levels of employment, a low carbon economy, productivity and social cohesion, to be implemented through concrete actions at EU and national levels. One of the seven flagship initiatives of Europe 2020, set out to define the key enabling role that the use of ICTs will have to play if Europe wants to succeed in its ambitions for 20202. 3 3 Open Data Strategy measures Composed of three complementary strands: i.Regulatory measures and soft law measures – revision of the PSI Directive and of Commission decision on re-use of its own information ii.Financing and support measures: Stimulating R&D&I in open data, creation of data portals; support from Connecting Europe Facilities and Europe 2020 (2014-2020) iii.Experience sharing between the Member States

4 4 Revision of the Directive main proposed changes (I) 1.Creation of a genuine right to re-use public data: all public data not covered by an exception is to be re-usable (does not apply to cultural institutions) 2.Limited extension of scope application of the minimal set of rules of the 2003 Directive (cultural institutions) with additional safeguards to: libraries (including university libraries) museums and archives 3.Obligation to define public task reference to administrative practice as a way of defining the scope of the public task is removed

5 5 Revision of the Directive main proposed changes (II) 4.Independent supervision required 5.Obligation on public bodies to make their documents available in a machine-readable format and together with their metadata where possible and appropriate 6.Charging rules are amended: charges shall be limited to the marginal costs of reproduction and dissemination (does not apply to cultural institutions) In exceptional cases public bodies may at maximum recover costs and claim a reasonable return on investment if duly justified Burden of proving compliance with charging rules shifts to public bodies

6 6 Open data strategy coordinating measures The PSI group: a Member States expert group for the exchange of good practices and initiatives supporting public-sector information re-use; includes a PSI sub- group on development of the pan-EU portal Networks and platforms funded by the Commission (the ePSI platform and the LAPSI network) The Commission will develop guidelines on licensing and price calculation after consulting stakeholders.

7 7 Open data strategy financing and support measures 1.Support R&D&I in data-handling technologies: 2011-2013: ~ 100 million support for technology innovation and uptake CIP-ICT PSP (2012)-2013 and Horizon 2020 2.Support for data infrastructures data portals for Europe Commission own data portal: pilot launch in Spring 2012 Pan-European data portal: single access point to datasets from across the EU, expected launch 2013 Support 2014-2020: Connecting Europe Facility (expected total funds for ICT/Digital: 9.2 billion)

8 8 Commission funding possibilities thematic networks -2012 The draft ICT PSP Work Programme 2012 approved by the CIP ICT Committee - formal approval by the Commission - end of January 2012 – 2 thematic networks in the area of open data: 1. Legal aspects of PSI legal experts Identification and discussion of legal barriers to access and re-use of PSI + suggestion of ways to overcome them 2.Standards for open data broad range of stakeholders elaboration of standards to enable interoperability and integration of PSI across EU and beyond
