5 IMPORTANCE Established the Supreme Court power of JUDICIAL REVIEW

6 THE CASE The state of Maryland put a tax on the Bank of the U.S., a federal institution

7 THE QUESTIONS 1.Is the Bank of the U.S. constitutional? 2.Can a state tax a federal agency?

8 THE DECISION 1.Yes, using the elastic clause 2.No, because of Supremacy Clause

9 IMPORTANCE Increased the power of the federal government over the states.

10 THE CASE Gibbons & Ogden both had ferry services from NY to NJ

11 THE QUESTION Can states regulate interstate commerce?

12 THE DECISION Interstate means movement BETWEEN 2 states

13 IMPORTANCE Established that the Federal government has complete control over interstate commerce.
